No. 417 of 2005 whereby the Reference was  partly allowed<br \/>\nand the dismissal order passed<br \/>\nby the Corporation on 29.03.2004 has been quashed and set aside. The<br \/>\npetitioner-Corporation was directed to reinstate the<br \/>\nrespondent-workman with continuity of service and without backwages.\n<\/p>\n<p>2.0\tThe<br \/>\ncase of the petitioner is that the respondent- Conductor was working<br \/>\nwith petitioner-Corporation. On 27.06.2003, on a surprise checking,<br \/>\nit was found that three tickets have been reissued.  The respondent<br \/>\nwas issued charge-sheet and after departmental inquiry, he was<br \/>\ndismissed from service on 29.03.2004. The respondent, therefore,<br \/>\nraised a dispute before the Labour Court by way of Reference (L.C.S.)<br \/>\nNo. 417 of 2005, wherein the Labour Court, Surat has passed the award<br \/>\nas stated hereinabove which is challenged in the present petition.\n<\/p>\n<p>3.0\tHeard<br \/>\nlearned advocates appearing for the respective parties and perused<br \/>\nthe documents on record.  As a result of this exercise, looking to<br \/>\nthe misconduct, I am of the view that such a misconduct would not<br \/>\nwarrant dismissal of the employee from service. Therefore, the Labour<br \/>\nCourt was justified in reinstating the respondent.\n<\/p>\n<p>4.0\tHowever,<br \/>\nit is found that there are as many as 88 defaults<br \/>\ncommitted by the respondent. It appears that the Labour<br \/>\nCourt has not considered the evidence produced on record in respect<br \/>\nof these defaults. This is a serious misconduct on the part of the<br \/>\nrespondent. The respondent is an employee of public sector and he is<br \/>\ndealing with public money. Misuse of public money is a serious<br \/>\nconduct. The Labour Court while exercising power 11(A) of the<br \/>\nIndustrial Disputes Act, 1947, has not imposed any penalty on the<br \/>\nrespondent. Therefore, if appropriate punishment is not imposed upon<br \/>\nthe respondent, it would imply that any one can commit such type of<br \/>\nmisconduct and can get away without adequate penalty. I am of the<br \/>\nview that imposition of penalty of stoppage of five increments with<br \/>\nfuture effect would meet the ends of justice.\n<\/p>\n<p>5.0\tIn<br \/>\nthe premises aforesaid,  a penalty of stoppage of five increments<br \/>\nwith future effect shall be imposed upon the respondent. The<br \/>\njudgement and award of the Labour Court is modified to the aforesaid<br \/>\nextent. The award shall be  implemented within a period of four<br \/>\nmonths from today.
