In review application, the original petitioner seeks<br \/>\nrecalling of the order dated 28.1.2005 passed by this Court in<br \/>\nSpecial Civil Application No.15861 of 2004.  By the said order,<br \/>\nchallenge made  by the petitioner to the disciplinary action taken by<br \/>\nthe employer-bank came to be turned down.   The petitioner was facing<br \/>\ndepartmental inquiry.  Charges were held to have been proved.  The<br \/>\nBank had therefore, removed her from service, which action was<br \/>\nchallenged in the main petition.  After detailed argument, the<br \/>\npetition was dismissed   by the said judgment dated 28.1.2005.\n<\/p>\n<p>\tThrough<br \/>\nthe review application, the original petitioner contends that to a<br \/>\nco-delinquent one Shri S.B.Shah, the Bank had indicated that if  he<br \/>\nadmits the charges, lesser punishment will be imposed and no such<br \/>\nfacility was  granted to the petitioner.  On the  ground of parity<br \/>\ntherefore, the petitioner seeks  reopening of the case.\n<\/p>\n<p>\tI<br \/>\n have considered the question of delay as well as  looked into the<br \/>\naverments made in the review petition.  I am not inclined to accept<br \/>\neither the delay condonation application or  the review petition for<br \/>\nthe following reasons.\n<\/p>\n<p>The<br \/>\n\tapplication for condonation of delay does not disclose sufficient<br \/>\n\tgrounds  to condone  the inordinate delay of more than 1000 days.<br \/>\n\tCounsel for the petitioner, however, relied on a decision of the<br \/>\n\tApex Court   reported in AIR 1987 SC 1353 wherein the Apex Court<br \/>\n\tdiscussed the phrase  sufficient cause . It was a case wherein<br \/>\n\tthe court below had refused to condone delay of 4 days in a State<br \/>\n\tappeal.\n<\/p>\n<p>That<br \/>\n\tthe petitioner should get the same benefits as granted to Shri Shah<br \/>\n\ton the basis of letter dated 4.6.2004 was not raised in the main<br \/>\n\tpetition.\n<\/p>\n<p>\tEven<br \/>\n\totherwise, the petitioner  has not laid full facts on record to<br \/>\n\tsuggest that what role said Shri Shah had played  vis-a-vis the<br \/>\n\tpresent petitioner.\n<\/p>\n<p>\tAt<br \/>\nthis distant point of time, I see no possibility of reopening the<br \/>\nissue which was closed way back in the year 2005.
