Code and under<br \/>\n\tSection 135 of the Bombay Police Act.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate for the applicant and learned A.P.P. for the<br \/>\n\trespondent &#8211; State.\n<\/p>\n<p>Learned<br \/>\n\tadvocate submitted that the applicant is an innocent person, wrongly<br \/>\n\tarraigned in the prosecution case. He also submitted that the<br \/>\n\tapplicant was not present at the scene of offence, but he was at<br \/>\n\tGodhra, since his wife was indoor patient in a hospital. Even there<br \/>\n\tis no any independent eye-witness to the incident. He therefore,<br \/>\n\tprayed that the applicant may kindly be released on bail by imposing<br \/>\n\tsuitable conditions.\n<\/p>\n<p>Learned<br \/>\n\tAPP Mr. Nanavati vehemently opposed the application of the<br \/>\n\tapplicant. He submitted that the applicant is involved in serious<br \/>\n\toffence and therefore, considering the quantum of punishment of the<br \/>\n\toffence in which the applicant is involved, discretion may not be<br \/>\n\texercised in favour of the applicant.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences,<br \/>\n\twithout discussing the evidence in detail, at this stage, I<br \/>\n\tam inclined to enlarge the applicant on bail.\n<\/p>\n<p>Learned<br \/>\n\tcounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>In<br \/>\n\tthe facts and circumstances of the case, the application is allowed<br \/>\n\tand the applicant is ordered to be released on bail in connection<br \/>\n\twith C.R. No. I 81 of 2011 registered with Morva (Hadaf) Police<br \/>\n\tStation, Panchmahals on executing a bond of Rs.10,000\/- (Rupees Ten<br \/>\n\tthousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the trial Court and subject to the conditions that<br \/>\n\the shall;\n<\/p>\n<p>not<br \/>\n\ttake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>maintain<br \/>\n\tlaw and order;\n<\/p>\n<p>surrender<br \/>\n\tpassport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>not<br \/>\n\tenter into the whole area of Morva (Hadaf) Police Station during the<br \/>\n\tcourse of trial;\n<\/p>\n<p>mark<br \/>\n\tpresence at the Raopura police station, Vadodara on 21st<br \/>\n\tday of every month between 10.00 a.m. and 12.00 p.m.;\n<\/p>\n<p>furnish<br \/>\n\tthe present address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the Sessions<br \/>\n\tJudge concerned will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
