Justice K.HEMA\n\n Dated :30\/01\/2009\n\n O R D E R\n                             K.HEMA, J.\n                      ----------------------------------\n                      B.A. No.7386 OF 2008\n                      ----------------------------------\n            Dated this the 30th day of January, 2009\n\n\n                              O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.<\/p>\n<p>      2. The alleged offences are under Sections 465, 468, 409,<\/p>\n<p>420 read with 34 of I.P.C. According to prosecution, first<\/p>\n<p>petitioner was working in a financial institution and she, in<\/p>\n<p>furtherance    of   common          intention        with her   husband,<\/p>\n<p>misappropriated the funds of the institution and thereby<\/p>\n<p>caused loss to the institution and also cheated the defacto<\/p>\n<p>complainant.\n<\/p>\n<p>      3. Learned counsel for petitioners submitted that<\/p>\n<p>petitioners are absolutely innocent of the allegations made.<\/p>\n<p>The money dealings are done by the Manager of the institution<\/p>\n<p>and first petitioner has no role in the same. She is only an<\/p>\n<p>employee in the institution and she is not quite educated. The<\/p>\n<p>petitioner&#8217;s husband has nothing to do with the institution, it is<\/p>\n<p>submitted.\n<\/p>\n<p>      4. Learned Public Prosecutor submitted that the<\/p>\n<p>compliant    as   a   whole       contains        vague   allegations of<\/p>\n<p>B.A.No.7386 of 2008<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>misappropriation etc. But there is an allegation regarding<\/p>\n<p>Rs.3Lakhs being advanced to one Anwar by first petitioner<\/p>\n<p>without the permission of the institution and in respect of the<\/p>\n<p>same, first accused has given a latter to the Company<\/p>\n<p>admitting it. Second petitioner has nothing to do with the<\/p>\n<p>Company, it is submitted.\n<\/p>\n<p>       On hearing both sides, considering the nature of<\/p>\n<p>allegations made against first petitioner, I am not inclined to<\/p>\n<p>grant anticipatory bail to her. But, as far as second accused is<\/p>\n<p>concerned, there are no sufficient materials in the case diary<\/p>\n<p>and therefore, he can be granted anticipatory bail. But, first<\/p>\n<p>petitioner is at liberty to raise all contentions before the trial<\/p>\n<p>court, if any bail application is filed under Section 437 Cr.P.C.<\/p>\n<p>and it shall be disposed of on merit considering all the<\/p>\n<p>contentions raised by her, in accordance with law. It is made<\/p>\n<p>clear that the considerations for an anticipatory bail<\/p>\n<p>application and an application under Section 437 Cr.P.C. are<\/p>\n<p>different.\n<\/p>\n<p>       In the result, the following order is passed.<\/p>\n<p>          1. The prayer for anticipatory bail by first<\/p>\n<p>B.A.No.7386 of 2008<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>               accused is rejected. She shall surrender<\/p>\n<p>               before the Magistrate court concerned or the<\/p>\n<p>               Investigating Officer and co-operate with the<\/p>\n<p>               investigation without any delay.\n<\/p>\n<p>          2. Second accused shall surrender before the<\/p>\n<p>               Magistrate court concerned within seven days<\/p>\n<p>               from today and he shall be released on bail on<\/p>\n<p>               his executing bond for Rs.25,000\/- with two<\/p>\n<p>               solvent sureties each for like sum to the<\/p>\n<p>               satisfaction of the learned Magistrate on the<\/p>\n<p>               following conditions :\n<\/p>\n<p>                i) He shall report before the Investigating<\/p>\n<p>                    Officer as and when directed.\n<\/p>\n<p>                ii) He shall not commit any offence while<\/p>\n<p>                    on bail.\n<\/p>\n<p>       The petition is partly allowed.\n<\/p>\n<\/p>\n<p>                                    K.HEMA, JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court C.P.Shobana vs The State Of Kerala Represented By on 30 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7386 of 2008() 1.
