SIRI JAGAN, J.\n                    ------------------------------\n                   W.P.(C) No.10765 OF 2006\n                   -------------------------------\n         Dated this the 16th day of September, 2010\n\n                         J U D G M E N T\n<\/pre>\n<p>      The petitioner is presently working as Overseer-Higher<\/p>\n<p>Grade) in the Kerala State Electricity Board.                The petitioner<\/p>\n<p>started service as an Electricity Worker and by promotions he<\/p>\n<p>became Line Helper, Line Assistant, Senior Line Assistant and as<\/p>\n<p>Overseer. While the petitioner was so working as Overseer, the<\/p>\n<p>Board created a post of Meter Reader and appointed overseers<\/p>\n<p>having the prescribed qualifications as Meter Readers.                 The<\/p>\n<p>petitioner&#8217;s grievance in this writ petition is that a junior of the<\/p>\n<p>petitioner in the cadre of Overseer is drawing higher pay than the<\/p>\n<p>petitioner and therefore, the petitioner is entitled to the benefit of<\/p>\n<p>stepping up of pay in accordance with Ext.P1 Board order.              The<\/p>\n<p>petitioner therefore seeks the following reliefs:<\/p>\n<blockquote><p>            &#8220;(i)  Issue a writ, order or direction in the nature of<br \/>\n            Mandamus or certiorari or other appropriate writ calling<br \/>\n            for records relating to Ext.P10 and Ext.P11 and quash<br \/>\n            the same holding the same as illegal and amounting to<br \/>\n            denial of equality and legal right of the petitioner.\n<\/p><\/blockquote>\n<blockquote><p>                  (ii)  To issue a writ, order or direction in the<br \/>\n            nature of Mandamus or other appropriate writ directing<br \/>\n            the respondents 1 to 3 herein to immediately confer<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.10765\/06                      2<\/span><\/p>\n<p>             the benefits Ext.P1 board order to the petitioner and<br \/>\n             step up the salary of the petitioner to give parity to<br \/>\n             him in the matter of salary with his juniors like<br \/>\n             Mr.Reghuvaran, who is entry No.2150 in Ext.P2<br \/>\n             gradation list.\n<\/p><\/blockquote>\n<blockquote><p>                    (iii)  Allow the petitioner to recover from the<br \/>\n             2nd respondent the full costs incurred for the<br \/>\n             institution and conduct of the writ petition&#8221;.<\/p><\/blockquote>\n<p>      2.    A counter affidavit has been filed on behalf of the<\/p>\n<p>first respondent wherein in paragraphs 5 and 6 it is stated<\/p>\n<p>thus:\n<\/p>\n<blockquote><p>       &#8220;5. It is submitted that, on verification of the related<br \/>\n       documents, it is noted that the junior is drawing a<br \/>\n       higher pay of Rs.2,425\/- (Rs.1225-2425) with effect<br \/>\n       from 18.08.1993 i.e., from the date on which he was<br \/>\n       promoted as Meter Reader while the petitioner draws<br \/>\n       Rs.2,195\/- on that date. The anomaly has arisen since<br \/>\n       the junior enjoyed the additional fixation benefit in the<br \/>\n       post of Meter Reader as compared to the petitioner.<br \/>\n       After the creation of the intermediary post of Meter<br \/>\n       Reader    an     Order  (B.O     No.PSI\/84\/88(55)    dated<br \/>\n       05.10.1990) was subsequently issued by the Board<br \/>\n       prescribing     the   qualifications   and    method    of<br \/>\n       appointment for the post of Meter Readers.             The<br \/>\n       petitioner is not having any of the Trade Certificates<br \/>\n       mentioned in the said Board order.        The Board order<br \/>\n       dated 30.12.1993 permits junior senior fixation only to<br \/>\n       those qualified lower category employees who were<br \/>\n       promoted as Overseers prior to the creation of the post<br \/>\n       of Meter Reader.\n<\/p><\/blockquote>\n<blockquote><p>       6.     It is submitted that, the Board vide B.O<br \/>\n       No.2473\/93 (PSI\/1533\/93) dated 30.12.1993, permits<br \/>\n       the benefit of Junior- Senior fixation of pay in the post<br \/>\n       of   Overseer     to  those    qualified  lower   category<br \/>\n       employees, who were promoted as Overseers prior to<br \/>\n       the creation of the intermediary post of Meter reader<br \/>\n       and who did not get the Rule 28A fixation benefit for<br \/>\n       the same&#8221;\n<\/p><\/blockquote>\n<p>3.    I have considered the rival contentions in detail. Going<\/p>\n<p>by Ext.P1, the petitioner would be entitled to stepping up of<\/p>\n<p><span class=\"hidden_text\">W.P.(c)No.10765\/06               3<\/span><\/p>\n<p>pay if the junior of the petitioner is drawing higher pay than<\/p>\n<p>the petitioner. The petitioner&#8217;s contention is that a junior of<\/p>\n<p>the petitioner, who is working as Meter Reader, is drawing<\/p>\n<p>higher pay. From the counter affidavit, it is clear that, that<\/p>\n<p>junior is drawing higher pay not in the cadre of Overseer but in<\/p>\n<p>the cadre of Meter Reader on account of fixation of pay when<\/p>\n<p>he was promoted as Meter Reader. Admittedly, the petitioner<\/p>\n<p>does not have the qualifications prescribed for appointment as<\/p>\n<p>Meter Reader. If he had the qualifications, he would also have<\/p>\n<p>been appointed as a Meter Reader in which case he would also<\/p>\n<p>have drawn the same salary as that of his junior. Therefore,<\/p>\n<p>the situation of the petitioner drawing lesser salary than his<\/p>\n<p>junior is not the one contemplated in Ext.P1 Board order, so as<\/p>\n<p>to enable the petitioner to be eligible for stepping up of pay in<\/p>\n<p>par with his junior. Therefore, the petitioner is not entitled to<\/p>\n<p>the benefit of stepping up of pay as provided in Ext.P1 Board<\/p>\n<p>order. Consequently, the petitioner is not entitled to the reliefs<\/p>\n<p>prayed for and accordingly, the writ petition is dismissed.<\/p>\n<p>                                    S.
