APP (DB) No.122 of 2011\n                       RAM BILASH CHOUDHARY\n                                Versus\n                         THE STATE OF BIHAR\n                               -----------\n<\/pre>\n<p>03\/   25.04.2011                Earlier, the appeal is admitted for<\/p>\n<p>                    hearing and it is directed that prayer for<\/p>\n<p>                    bail shall be considered after receipt of the<\/p>\n<p>                    lower court records by order dated 25.02.2011.<\/p>\n<p>                                The   lower    court        records    has     been<\/p>\n<p>                    received    and    the    appellant       has     prayed    for<\/p>\n<p>                    bail.\n<\/p>\n<p>                                It    has    been     submitted        that     the<\/p>\n<p>                    allegation was that the assault was by means<\/p>\n<p>                    of fists, slaps and Lathi which resulted into<\/p>\n<p>                    death. Further submission is that the post-<\/p>\n<p>                    mortem report has not been brought on record<\/p>\n<p>                    due to non-examination of the doctor and so<\/p>\n<p>                    the cause of death could not be ascertained.<\/p>\n<p>                    It has also been submitted that most of the<\/p>\n<p>                    witnesses have been declared hostile but the<\/p>\n<p>                    investigating       officer       has     also     not     been<\/p>\n<p>                    examined so, the appellant was prejudiced.<\/p>\n<pre>                                Considering           the        facts          and\n\n                    circumstances      of     the     case,    the     appellant\n\n<\/pre>\n<p>                    namely, Ram Bilash Choudhary, during pendency<\/p>\n<p>                    of the appeal, is directed to be released on<\/p>\n<p>                    bail on furnishing bail bond of Rs. 10,000\/-<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>            (ten thousand) with two sureties of the like<\/p>\n<p>            amount each     to the satisfaction of Shri Om<\/p>\n<p>            Prakash-IV, learned Additional Sessions Judge,<\/p>\n<p>            Fast Track Court No. IV\/his successor court,<\/p>\n<p>            Khagaria in connection with Sessions Case No.<\/p>\n<p>            340 of 2004\/Sessions Trial No. 132 of 2010.<\/p>\n<pre>                       Realization      of    fine      during    the\n\n            pendency   of   this    appeal    against    the     above\n\n<\/pre>\n<p>            named appellant shall remain stayed.<\/p>\n<pre>\n\n\n                         (Shyam Kishore Sharma, J.)\n\n\n\nkksinha\/-                       (Gopal Prasad, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Bilash Choudhary vs The State Of Bihar on 25 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.
