JUSTICE SABINA\n\n\nPresent:   Mr. Amrit Lal Jain, Advocate.\n           for the petitioner.\n\n           None for the respondent.\n\n                 ****\nSABINA, J.\n<\/pre>\n<p>           Plaintiff-Mahfuz-ur-Rehman filed a suit for possession by<\/p>\n<p>way of ejectment and for recovery of arrears of rent\/mesne profits.<\/p>\n<p>           Notice of the suit was issued to the defendant.\n<\/p>\n<p>           During the pendency of the suit, an application under<\/p>\n<p>Order 15 Rule 5 read with Section 151 of the Code of Civil Procedure<\/p>\n<p>was filed by the plaintiff. It was averred that the defendant had failed<\/p>\n<p>to deposit the entire amount of compensation for use and occupation<\/p>\n<p>along with interest and hence, his defence was liable to be struck off.<\/p>\n<p>Vide the impugned order dated 19.7.2002, the said application was<\/p>\n<p>allowed by the Civil Judge (Jr.Divn.) Gurgaon. Hence, the present<br \/>\n<span class=\"hidden_text\"> Civil Revision No.5456 of 2002                              2<\/span><\/p>\n<p>revision petition by the defendant.\n<\/p>\n<p>           Learned counsel for the petitioner has submitted that now<\/p>\n<p>there was no relationship of landlord and tenant between the parties.<\/p>\n<p>The plaintiff had executed an agreement to sell in favour of the<\/p>\n<p>defendant and had received the entire sale consideration and hence,<\/p>\n<p>the defendant was not in possession of the property in question as a<\/p>\n<p>tenant. In these circumstances, the defendant was not required to<\/p>\n<p>pay any compensation or rent to the plaintiff.\n<\/p>\n<p>           In support of his argument, learned counsel for the<\/p>\n<p>petitioner has placed reliance on R.Kanthimathi and other v. Mrs.<\/p>\n<p>Beatrice Xavier Vol. CXXIX (2001-3) PLR, 587, wherein it has been<\/p>\n<p>held as under:-\n<\/p>\n<p>                       &#8220;Thus    within   this    legal   premises,   the<\/p>\n<p>           submission by learned counsel for the respondent of<\/p>\n<p>           revival of their old relationship of landlord and tenant<\/p>\n<p>           when she repudiates this agreement by sending back to<\/p>\n<p>           the    tenant   Rs.20,000\/-   through    a    cheque   (which<\/p>\n<p>           according to the appellant was not encashed) cannot be<\/p>\n<p>           accepted. So we have no hesitation to reject the same.<\/p>\n<p>           Every conduct of the landlady right from the date of<\/p>\n<p>           entering into agreement of sale, accepting money towards<\/p>\n<p>           the sale consideration, delivering possession in lieu of<\/p>\n<p>           such agreement all clearly indicates and has to be<\/p>\n<p>           construed in law that she repudiated her old relationship<br \/>\n<span class=\"hidden_text\"> Civil Revision No.5456 of 2002                            3<\/span><\/p>\n<p>           of landlord and tenant. Thus, after the parties enter into<\/p>\n<p>           new cloak of seller and purchaser and their relationship to<\/p>\n<p>           be governed under the said terms of the agreement.<\/p>\n<p>           Every right and obligation thereafter would flow from it.<\/p>\n<p>           Even if parties under the agreement of sale do not<\/p>\n<p>           perform their obligations remedy may be availed in law as<\/p>\n<p>           permissible under the law. Hence, we have no hesitation<\/p>\n<p>           to hold that Courts below including High Court committed<\/p>\n<p>           error in holding that tenant committed wailful default.<\/p>\n<p>           When appellant is no more tenant how can non-payment<\/p>\n<p>           be construed as wailful default.&#8221;\n<\/p>\n<p>           After hearing learned counsel for the petitioner, I am of<\/p>\n<p>the opinion that this revision petition deserves to be allowed.<\/p>\n<p>           The petitioner, in the present case, has denied the<\/p>\n<p>relationship of landlord and tenant between the parties. The question<\/p>\n<p>that requires consideration is as to whether in the facts and<\/p>\n<p>circumstances of the present case, the petitioner is required to<\/p>\n<p>deposit entire amount of compensation for use and occupation of<\/p>\n<p>the premises in dispute during the continuation of the suit?<\/p>\n<p>           The plaintiff had filed a suit for possession by way of<\/p>\n<p>ejectment and recovery of arrears of rent\/mesne profits.          The<\/p>\n<p>defendant, on the other hand, has taken the stand that he was no<\/p>\n<p>longer in possession of the property in dispute as a tenant. Rather<\/p>\n<p>he was in possession of the premises in dispute on the basis of part<br \/>\n<span class=\"hidden_text\"> Civil Revision No.5456 of 2002                            4<\/span><\/p>\n<p>performance of agreement to sell entered between the parties.<\/p>\n<p>           Admittedly, the defendant was inducted as a tenant by the<\/p>\n<p>plaintiff. However, the case of the defendant is that the plaintiff has<\/p>\n<p>agreed to sell the premises in dispute to the defendant and<\/p>\n<p>agreement to sell in this regard was executed between the parties.<\/p>\n<p>The defendant was now in possession of the premises in dispute on<\/p>\n<p>the basis of the agreement to sell and hence, the relationship of<\/p>\n<p>landlord and tenant between the parties had come to an end.<\/p>\n<p>           It has been held by the Apex Court in R.Kanthimathi&#8217;s<\/p>\n<p>case (Supra) that once there is an agreement to sell between the<\/p>\n<p>parties, then the old relationship of landlord and tenant comes to an<\/p>\n<p>end. The defendant has based his possession on the basis of part<\/p>\n<p>performance of agreement to sell.      Parties are yet to lead their<\/p>\n<p>evidence in support of their case.      In these circumstances, the<\/p>\n<p>learned trial Court   had erred in striking off the defence of the<\/p>\n<p>defendant on the ground that he failed to deposit the rent after<\/p>\n<p>appearing in the Court. In the facts and circumstances of the case,<\/p>\n<p>the defence of the defendant could not be struck of.<\/p>\n<p>           Accordingly, this revision petition is allowed.         The<\/p>\n<p>impugned order dated        19.7.2002 passed by the Civil Judge<\/p>\n<p>(Jr.Divn.)
