Justice M.SASIDHARAN NAMBIAR\n\n Dated :12\/03\/2010\n\n O R D E R\n            M.SASIDHARAN NAMBIAR,J.\n          ===========================\n           W.P.(C)No.4042    OF 2010\n          ===========================\n\n     Dated this the 12th day of March,2010\n\n                   JUDGMENT\n<\/pre>\n<p>    This petition is filed under Article 226 of<\/p>\n<p>the  Constitution  of  India   for  a  writ  of<\/p>\n<p>mandamus commanding respondents 2 and 3 to<\/p>\n<p>consider Exts.P7 and P8 applications within a<\/p>\n<p>time frame and to suspend the sentence till<\/p>\n<p>Exts.P7 and P8 are disposed of.<\/p>\n<p>    2.    Learned  counsel  appearing  for  the<\/p>\n<p>petitioner and learned Government pleader were<\/p>\n<p>heard.\n<\/p>\n<p>    3.  The question is squarely covered by the<\/p>\n<p>decision of the Division Bench of this court in<\/p>\n<p><a href=\"\/doc\/912930\/\">Moideenkoya v. Secretary<\/a> to Government (2008(4)<\/p>\n<p>KLT 257).  The Division Bench held that it is<\/p>\n<p>for the Government to decide whether the power<\/p>\n<p>under  section  432\/433  of  Code  of  Criminal<\/p>\n<p>Procedure is to be invoked and this court<\/p>\n<p><span class=\"hidden_text\">W.P.(C)4042\/2010            2<\/span><\/p>\n<p>cannot direct     the Government to exercise the power<\/p>\n<p>in one way or the other.
