JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/07\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE JAYANT PATEL)<\/p>\n<p>This<br \/>\n\tCourt (Coram: A.L. Dave and Ms.H.N. Devani, J.J.), on 2.2.2010, had<br \/>\n\tpassed the following order :-\n<\/p>\n<p> \tOpponent<br \/>\n\tNo.4, Baldevbhai M. Patel, party-in-person, is present.  When his<br \/>\n\tattention was drawn to use of improper language and improper<br \/>\n\tbehaviour and to likelihood of exposing himself to fresh contempt<br \/>\n\tproceedings by this Court and when he was asked if he would like to<br \/>\n\tengage an advocate or would need help of an advocate under legal<br \/>\n\taid, he indicated that he would engage an advocate within ten days.<br \/>\n\tHence, S.O. to 16.2.2010.\n<\/p>\n<p>Thereafter,<br \/>\n\tthe reply has been submitted dated 6.7.2010 and in the reply itself,<br \/>\n\tthe contempnor has gone to the extent of, not only using<br \/>\n\tunparliamentary language, but also making allegations against the<br \/>\n\tearlier Bench of this Court.  Prima facie, such can be said to be a<br \/>\n\tcriminal contempt on the face of the Court and that too, against the<br \/>\n\tContempt Bench before the Contempt Bench.  Stern action and strong<br \/>\n\tpunishment would be required to be imposed, if ultimately sufficient<br \/>\n\texplanation does not come on record.\n<\/p>\n<p>At<br \/>\n\tthis stage, Mr.Yagnik, learned Counsel appearing for the contempnor,<br \/>\n\tseeks time to file reply and submit explanation, if any, available<br \/>\n\tto him.\n<\/p>\n<p>Hence,<br \/>\n\tS.O. to 13.8.2010.  It is<br \/>\n\tdirected that the contempnor shall personally remain present.\n<\/p>\n<p>\tWe<br \/>\n\twould have directed the Police Inspector of Ghatlodia Police Station<br \/>\n\tto ensure the presence of the contempnor.  However, Mr.Yagnik,<br \/>\n\tlearned Counsel appearing for the contempnor, under the instructions<br \/>\n\tof his client, undertakes that the contempnor, who is present, shall<br \/>\n\tremain personally present on the next date.\n<\/p>\n<p>\tWe<br \/>\n\talso direct that the State of Gujarat through learned Public<br \/>\n\tProsecutor and the Police Inspector, Ghatlodia Police Station, shall<br \/>\n\tbe impleaded as party respondents.
