Vinay Singh, S\/o Late Pashupati Nath Singh, resident of village-Barua,\n                    P.S.-Dighwara, district-Saran.            ..........Petitioners\n                                         Versus\n                  The State of Bihar                          ........Opp. Party.\n                                         -----------\n<\/pre>\n<p>2   25.10.2011                   Heard learned counsel for the petitioners and learned<\/p>\n<p>                       counsel appearing on behalf of the State.\n<\/p>\n<p>                                 The petitioners apprehend their arrest in connection<\/p>\n<p>                       with a case registered for the offence under Sections 323, 379,<\/p>\n<p>                       406, 427, 504\/34 of the Indian Penal Code and Section 3 (i) (x) of<\/p>\n<p>                       the S.C. &amp; S.T. (Prevention of Atrocities) Act.<\/p>\n<p>                                 It is stated that wife of petitioner no. 1 and mother of<\/p>\n<p>                       petitioner no. 2 are ward members of ward no. 7 and ward no. 14<\/p>\n<p>                       respectively. They made representation to the District Magistrate<\/p>\n<p>                       and Divisional Commissioner regarding certain irregularities and<\/p>\n<p>                       mis-conduct of the Mukhiya of Gram Panchayat, Barua and the<\/p>\n<p>                       informant being a supporter of the Mukhiya has been set up by<\/p>\n<p>                       her and a malicious prosecution has been launched. Advancing<\/p>\n<p>                       the argument it is further stated that the petitioner no. 1 had made<\/p>\n<p>                       a complaint to the D.M., Saran, Chapra with regard to illegal<\/p>\n<p>                       allotment of Indira Awas on 9.4.2007. In the complaint the name<\/p>\n<p>                       of the informant and his wife has been given and it was alleged<\/p>\n<p>                       that the Mukhiya, Panchayat Secretary and the Panchayat<\/p>\n<p>                       Supervisor in conspiracy with each other had committed serious<br \/>\n<span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>                irregularities in selection of beneficiaries under the Indira Awas<\/p>\n<p>                Scheme. In this background no one would believe that the<\/p>\n<p>                complainant would have given money to the petitioner no. 1.<\/p>\n<p>                Further on admitted facts of complaint the complainant would<\/p>\n<p>                himself be liable to be prosecuted for criminal breach of trust as<\/p>\n<p>                he admits that he being a beneficiary under the Indira Awas<\/p>\n<p>                Scheme gave the money to petitioner no. 1 as loan which under<\/p>\n<p>                no circumstance would be permissible in law. In course of<\/p>\n<p>                investigation, some of the witnesses have supported the defence<\/p>\n<p>                version. It is also submitted that the present case is a gross case of<\/p>\n<p>                misuse of Section 3(i) (x) of the Scheduled Castes &amp; Scheduled<\/p>\n<p>                Tribes (Prevention of Atrocities) Act.\n<\/p>\n<p>                          Be that as it may considering the facts and<\/p>\n<p>                circumstances of the case, let the petitioners, namely (i) Ranvijay<\/p>\n<p>                Singh @ Bhikhari Singh, (ii) Raju Singh and (iii) Vinay Singh in<\/p>\n<p>                the event of their arrest or surrender before the Court below<\/p>\n<p>                within   a   period    of   four    weeks    from     the   date   of<\/p>\n<p>                receipt\/communication of this order, be released on bail on<\/p>\n<p>                furnishing bail bonds of Rs. 5,000\/- (Five thousand only) with<\/p>\n<p>                two sureties of the like amount each to the satisfaction of the<\/p>\n<p>                learned Chief Judicial Magistrate, Hajipur in connection with<\/p>\n<p>                Hajipur S.C. &amp; S.T.
