The present petition has been filed under<br \/>\nSection 482 Cr.P.C. for quashing of the criminal<br \/>\ncomplaint dated November 22, 1991 filed under Sections<br \/>\n3K(i), 17, 18, 29 and 33 of the Insecticide Act, 1968,<br \/>\ncopy of the aforesaid complaint has been appended as<br \/>\nAnnexure P-1 with the petition.\n<\/p>\n<p>2. I have heard Shri Vibhore Bansal, Learned<br \/>\nCounsel appearing for the petitioners and Shri Sandeep<br \/>\nJain, learned Assistant Advocate General, Punjab appearing<br \/>\nfor the respondent and with their assistance have also<br \/>\ngone through the contents of the complaint as well as the<br \/>\ncontents of the present petition.\n<\/p>\n<p>3. In my considered opinion, no case is made out<br \/>\nfor exercising of the inherent powers of this Court under<br \/>\nSection 482 Cr.P.C. Various pleas have been raised by the<br \/>\npetitioners challenging the filing of the complaint and<br \/>\ncontinuation thereof. However, I find that those pleas<br \/>\nneed to be raised by the petitioners before the learned<br \/>\ntrial Magistrate.\n<\/p>\n<p>4. Accordingly, the present petition is hereby<br \/>\ndismissed. However, a liberty is granted to the<br \/>\npetitioners to file an appropriate application before the<br \/>\nlearned trial Magistrate for dropping of the proceedings<br \/>\nagainst tem. While filing the aforesaid application, it<br \/>\nshall be open to the petitioners to raise all the pleas<br \/>\nraised in the present petition and other defences<br \/>\navailable to tem in accordance with law before the trial<br \/>\nCourt. If any such application is filed by the<br \/>\npetitioners then the trial Magistrate would decide the<br \/>\nsame on merits after affording an opportunity of hearing<br \/>\nto all concerned.\n<\/p>\n<p>5. The personal presence of the petitioners shall<br \/>\nalso remain exempted during the course of trial. However,<br \/>\nthe learned trial Court is at liberty to secure the<br \/>\npersonal presence of the petitioners as and when the same<br \/>\nis required by it is accordance with law.\n<\/p>\n<p>6.
