Koshy, J<\/p>\n<p>       This is an appeal filed by the Insurance<\/p>\n<p>Company. The respondents\/ applicants are the<\/p>\n<p>dependents of 22 years old man. They applied<\/p>\n<p>for compensation under Workmen&#8217;s Compensation<\/p>\n<p>Act contending that due to the negligence of<\/p>\n<p>the first respondent\/the driver of the lorry<\/p>\n<p>owned by the second respondent                          and insured by<\/p>\n<p>the    third     respondent,              their         son    sustained<\/p>\n<p>serious injuries and died in the course of<\/p>\n<p>employment. It is also submitted that he was<\/p>\n<p>employed by the second respondent as loading<\/p>\n<p>and unloading worker in the lorry bearing<\/p>\n<p>registration No.KL.11C.779. The death due to<\/p>\n<p>the accident is not disputed. The Commissioner<\/p>\n<p>for      Workmen&#8217;s             Compensation                  awarded   a<\/p>\n<p>compensation of Rs.2,87,781\/- for the death of<\/p>\n<p>the son of the applicants. Third respondent\/<\/p>\n<p><span class=\"hidden_text\">M. F. A No.562 of 2003              -2-<\/span><\/p>\n<p>       Insurance        Company     questioned   the    award<\/p>\n<p>       contending that on the basis of Asharani&#8217;s<\/p>\n<p>       case decision <a href=\"\/doc\/1761200\/\">(New India Insurance Co. Ltd. v. Asha Rani<\/p>\n<p>       and ors.<\/a> (2003) 2 SCC 223) nobody can be carried in a<\/p>\n<p>       goods carriage and the claim of any such<\/p>\n<p>       person is not liable to be fixed on the<\/p>\n<p>       insurer under the statute. It is true that in<\/p>\n<p>       view of the decision of the Hon. Apex Court in<\/p>\n<p>       Asha Rani&#8217;s case (cited supra) passenger in a<\/p>\n<p>       goods vehicle is not covered by the policy<\/p>\n<p>       unless there is specific coverage mentioned in<\/p>\n<p>       the policy. Ext.R1 is the insurance policy<\/p>\n<p>       certificate.       The    above  certificate   clearly<\/p>\n<p>       shows that it is intended for carriage of<\/p>\n<p>       goods. Clause No.3 limitation of use says that<\/p>\n<p>       it does not cover passengers in the vehicle<\/p>\n<p>       except        employees   (other   than  driver)    not<\/p>\n<p>       exceeding six in number under the purview of<\/p>\n<p>       Workmen&#8217;s         Compensation     Act,   1923      and<\/p>\n<p>       thereafter, driver was specifically covered.<\/p>\n<p>       Therefore, there was a condition in the policy<\/p>\n<p><span class=\"hidden_text\">M. F. A No.562 of 2003            -3-<\/span><\/p>\n<p>       to cover passengers who are employees not<\/p>\n<p>       exceeding six in number. But they are only<\/p>\n<p>       entitled to compensation as provided under<\/p>\n<p>       Workmen&#8217;s        Compensation   Act.    Contributory<\/p>\n<p>       negligence by not travelling in a cabin etc.<\/p>\n<p>       is not a ground for denying compensation under<\/p>\n<p>       the Workmen&#8217;s Compensation Act. In view of the<\/p>\n<p>       specific        coverage in   the  policy    of    six<\/p>\n<p>       employees        other  than   driver    under     the<\/p>\n<p>       Workmen&#8217;s Compensation Act, we are of the view<\/p>\n<p>       that the Insurance Company is liable to pay<\/p>\n<p>       compensation and no interference is required<\/p>\n<p>       in the award passed by the Commissioner for<\/p>\n<p>       Workmen&#8217;s Compensation.        Appeal fails and is<\/p>\n<p>       dismissed accordingly.\n<\/p>\n<\/p>\n<p>                                                  J. B.
