Saikia, Chief Justice,\nHonble Mr. Justice Sunil Hali, Judge\nDate: 01.06.2010 \n:J U D G M E N T :\n<\/pre>\n<p>Per- Hali- J<br \/>\nThis appeal has been preferred against the judgment of<br \/>\nlearned Single Judge dated 22.03.2004 passed in SWP no.<br \/>\n897\/2003. While disposing of the writ petition the learned Single<br \/>\nJudge directed the respondents to grant promotion to the writpetitioner<br \/>\nas Assistant Commandant with effect from<br \/>\n11.09.2001 when the private respondent was promoted.<br \/>\nIn order to appreciate the controversy involved in the<br \/>\npresent appeal, certain facts are required to be noticed.<br \/>\nThe writ-petitioner-respondent was recruited as Sub<br \/>\nInspector on 21.11.1984 and was promoted as Inspector on<br \/>\n25.09.1990. On the basis of his seniority, he became eligible for<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\npromotion as Assistant Commandant in the year 1996. He was<br \/>\nnot promoted and the reason indicated was that he had not<br \/>\nundergone the mandatory Platoon Weapon Course and<br \/>\nCompany Commander course, which was essential condition<br \/>\nfor making such promotion. Writ petitioner was sent on<br \/>\ndeputation to Special protection Group, New Delhi and request<br \/>\nwas made for relieving him for undergoing the said training<br \/>\ncourse, which was declined by the borrowing department.<br \/>\nVarious Departmental Promotion Committees were constituted<br \/>\nbut the petitioners case was not considered due to the fact that<br \/>\nhe had not undergone the special training course. In the<br \/>\nmeanwhile the private respondent R. S. Yadav, who was junior<br \/>\nto the petitioner, was promoted as Assistant Commandant on<br \/>\n11.09.2001. The writ petitioner was finally promoted as<br \/>\nAssistant Commandant on 28.06.2002.\n<\/p>\n<p>The grievance set out by the writ petitioner was that<br \/>\ndespite being eligible and senior he was not deputed for the<br \/>\nmandatory training course as a result of which he could not<br \/>\nattain the eligibility for being promoted to the higher post. The<br \/>\nfault lies with the respondents in this behalf as they were<br \/>\nrequired to depute him for undergoing the necessary training<br \/>\ncourse.\n<\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p>Writ petitioners further contention was that he had<br \/>\nundergone the mandatory training course from January 2001 to<br \/>\nApril, 2001, but despite that he was not promoted by the<br \/>\nrespondents when the DPC met in June, 2001.<br \/>\nThe stand of the respondents before the writ Court was<br \/>\nthat petitioner was not eligible for promotion as he had not<br \/>\nundergone the mandatory training course, which was the prerequisite<br \/>\nfor such promotion. It is further contended by the<br \/>\nrespondents that even though the writ petitioner underwent the<br \/>\nsaid training course from 29th of January, 2001 to 7th of April,<br \/>\n2001, but he could not be promoted by the Departmental<br \/>\nPromotion Committee constituted on 2nd of June, 2001, as<br \/>\naccording to the instructions issued by DOP&amp;T, New Delhi on<br \/>\n01.02.1999, the crucial date for determining the eligibility of<br \/>\nSubedars was 1st of January, 2001. The writ petitioner had not<br \/>\nobtained the eligibility as on 1st of January, 2001, which was the<br \/>\ndate for determination of the eligibility for promotion to the post<br \/>\nof Assistant Commandant, as such, his case could not have<br \/>\nbeen considered for promotion.\n<\/p>\n<p>We have heard the learned counsel for the parties.<br \/>\nThe learned Single Judge has allowed the writ petition<br \/>\nsolely on the ground that the writ petitioner was senior to the<br \/>\nprivate respondent and was required to be considered for<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\npromotion to the post of Assistant Commandant with effect from<br \/>\n11.09.2001, when his junior was promoted.<br \/>\nThere is no dispute that writ petitioner admittedly was<br \/>\nsenior to the private respondent, which fact stands admitted by<br \/>\nthe respondents also. The issue which was required to be<br \/>\naddressed by the learned Single Judge was as to whether the<br \/>\nwrit petitioner was eligible for promotion on the crucial date.<br \/>\nEligibility would determine his right of promotion to the higher<br \/>\npost. The stand of the respondents in this behalf was that the<br \/>\ncrucial date for determining the eligibility was 1st of January,<br \/>\n2001, and, on that date the writ petitioner had not acquired the<br \/>\neligibility for promotion. This aspect of the matter has not been<br \/>\nconsidered by the learned Single Judge. As a matter of fact,<br \/>\nthis was the crucial issue which was required to be determined<br \/>\nby the learned Single Judge. Seniority may be one of the<br \/>\ncriterions for promotion but the most important aspect was<br \/>\nacquiring the eligibility for such promotion. This issue has been<br \/>\nleft un-settled by the learned Single Judge.<br \/>\nWe, therefore, allow this appeal, set aside the impugned<br \/>\njudgment and remand the matter to the learned writ Court, with<br \/>\na request to hear the parties afresh on the issue of eligibility. It<br \/>\nis expected that the matter will be disposed of by the learned<br \/>\nSingle Judge within a period of two months.\n<\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>Registry is directed to list the writ petition before the writ<br \/>\nCourt in the first week of July, 2010.\n<\/p>\n<p>(Sunil Hali) (Dr. Aftab H.
