This   writ   appeal   has   been   filed   challenging   the   order<\/p>\n<p>dated   29th  August,   2005   passed   by   the   learned   Single   Judge  in<\/p>\n<p>W.P.(C) No.23180 of 2005.   Petitioner in the original lis and the<\/p>\n<p>first respondent in the present writ appeal   sought appointment<\/p>\n<p>on compassionate grounds.   It is the case of the petitioner that<\/p>\n<p>her   brother   Sreekumaran   Namboodiri   who   was   an   employee   of<\/p>\n<p>the   Devaswom   Board   died   in     harness.     Her   application   was<\/p>\n<p>rejected   by   the   competent   authority   vide   order   Ext.P2   dated<\/p>\n<p>26.4.2005.     It   was   stated   in   the   order   that   the   petitioner   is<\/p>\n<p>married   and   that   being   so   she   would   not   be   entitled   for<\/p>\n<p>appointment on compassionate grounds because of the demise of<\/p>\n<p>her   brother   under   the   Scheme.     It   is   this   order   that   was<\/p>\n<p>challenged   by   the   petitioner.     Clause   6(5)   of   the   Dying-in-\n<\/p>\n<p>Harness Scheme reads as follows:\n<\/p>\n<p><span class=\"hidden_text\">W.A.No.49\/2006                           2<\/span><\/p>\n<blockquote><p>              &#8220;An   unemployed   married   son   or   any<\/p>\n<p>       unemployed married daughter whose spouse is also<\/p>\n<p>       unemployed can also be considered for appointment<\/p>\n<p>       under these rules, provided the other dependents of<\/p>\n<p>       the deceased Devaswom employee are being looked<\/p>\n<p>       after by him\/her.&#8221;<\/p><\/blockquote>\n<p>      3. It is apparent from a reading of the clause aforesaid that<\/p>\n<p>an   unemployed   married   son   or   unemployed   married   daughter<\/p>\n<p>whose   spouse   is   also   unemployed   would   be   entitled     for<\/p>\n<p>consideration under the Scheme.  Even though by virtue of clause<\/p>\n<p>6 relied upon by the learned Single Judge she may be under the<\/p>\n<p>category   of   eligible   relations   entitled   to   compassionate<\/p>\n<p>appointment, but the case of the sister cannot be better than that<\/p>\n<p>of son and daughter. It is conceded position that the husband of<\/p>\n<p>the   petitioner   is   an   employee.     That   being   so,   petitioner   is   not<\/p>\n<p>entitled for  appointment on compassionate grounds.  That apart,<\/p>\n<p>the   category   of   persons   mentioned   in   the   Scheme   at   the   most<\/p>\n<p>would   be   entitled     for   consideration   for   appointment   on<\/p>\n<p>compassionate   grounds.     The   mere   fact   that   they   are   entitled<\/p>\n<p>would   not   automatically   mean   that   they   may   necessarily   be<\/p>\n<p>employed.  It is too well settled that compassionate appointment<\/p>\n<p>is   to   be   given   to   tide   over   the   immediate   crisis.     Surely,   the<\/p>\n<p><span class=\"hidden_text\">W.A.No.49\/2006                           3<\/span><\/p>\n<p>petitioner  whose spouse being an employed person would not be<\/p>\n<p>in   immediate   crisis.       We   find   considerable   merit   in   the   appeal<\/p>\n<p>preferred by the appellants and it is allowed.   Consequently, the<\/p>\n<p>order passed by the learned Single Judge is set aside and the writ<\/p>\n<p>petition   filed   by   the   petitioner   is   dismissed.     There   will   be   no<\/p>\n<p>order as to costs.\n<\/p>\n<p>                                                           V.K.
