APP (DB) No.1114 of 2010\n                            SHYAM YADAV\n                                  Versus\n                            STATE OF BIHAR\n                                 -----------\n<\/pre>\n<p>02\/   21.09.2010             Admit the appeal.<\/p>\n<p>                             LCR has already been called in Cr. Appeal No.<\/p>\n<p>                   1103 of 2010.\n<\/p>\n<p>                             The appellant has been convicted under<\/p>\n<p>                   Section 302 of the IPC and 27 of the Arms Act.<\/p>\n<p>                             Counsel for the appellant submits that there is<\/p>\n<p>                   no eye witness to the occurrence. Only eye witness PW<\/p>\n<p>                   1, the daughter of the deceased did not support the case<\/p>\n<p>                   of prosecution so far identification of the appellant is<\/p>\n<p>                   concerned. It is also stated that there is general and<\/p>\n<p>                   omnibus allegation against all four accused.
