SANKARAN, J.\n                       ---------------------------\n                       B.A. No. 3028 of 2009\n                   ------------------------------------\n               Dated this the 10th day of June, 2009\n\n                            O R D E R\n<\/pre>\n<p>       This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure.        Petitioners are accused Nos.1, 2<\/p>\n<p>and 3 in Crime No. 718\/2009 of Chengannur Police Station.<\/p>\n<p>       2. The offence alleged against the petitioners are under<\/p>\n<p>Sections 308, 324 read with Section 34 of the Indian Penal<\/p>\n<p>Code.\n<\/p>\n<p>       3. It is stated that the accused No.4 was granted<\/p>\n<p>anticipatory bail as she was suffering from Jaundice. The<\/p>\n<p>petitioners had also applied for anticipatory bail. Their prayer<\/p>\n<p>for anticipatory bail was rejected. They surrendered before the<\/p>\n<p>investigating officer on 28\/05\/2009 and they produced before<\/p>\n<p>the court. The petitioners are in judicial custody. It is submitted<\/p>\n<p>by the learned counsel for the petitioner that the defacto<\/p>\n<p>complainant is a relative of the petitioner and there were family<\/p>\n<p>disputes.   The learned Public Prosecutor submitted that the<\/p>\n<p>B.A. No.3028\/2009<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>injuries sustained by the defacto complainant are not very<\/p>\n<p>serious.\n<\/p>\n<p>         4. Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioners, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioners.\n<\/p>\n<p>         5. The petitioners shall be released on bail on their<\/p>\n<p>executing a bond for Rs.25,000\/- each with two solvent sureties<\/p>\n<p>each for the like amount to the satisfaction of the Judicial<\/p>\n<p>Magistrate of the First Class, Chengannur subject to the following<\/p>\n<p>conditions:-\n<\/p>\n<blockquote><p>                 A) The petitioners shall report before the<br \/>\n                    Investigating Officer between 9 A.M. and<br \/>\n                    11 A.M. on all Mondays, till the final report<br \/>\n                    is filed or until further orders.\n<\/p><\/blockquote>\n<blockquote><p>                 B) The petitioners shall      appear before the<br \/>\n                    Investigating Officer for interrogation as<br \/>\n                    and when required.\n<\/p><\/blockquote>\n<blockquote><p>                 C) The petitioners shall not try to influence<br \/>\n                    the prosecution witnesses or tamper with<br \/>\n                    the evidence.<\/p><\/blockquote>\n<p>                 D)  The petitioners shall not commit any<\/p>\n<p>B.A. No.3028\/2009<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>                    offence or indulge in any prejudicial<br \/>\n                    activity while on bail.\n<\/p>\n<p>                 E) In case of breach of any of the conditions<br \/>\n                    mentioned above, the bail shall be liable<br \/>\n                    to be cancelled.\n<\/p>\n<p>         The Bail Application is allowed as above.<\/p>\n<p>                                     K.T.
