THE ASSISTANT ENGINEER, BIHAR STATE HOUSING BOARD, DARBHANGA\nDIVISION, DARBHANGA\n                                  -----------\n<\/pre>\n<p>3\/   02\/12\/2010               Heard learned counsel for the petitioner and<\/p>\n<p>                  learned counsel for the Bihar State Housing Board.<\/p>\n<p>                              Despite the writ application having been filed<\/p>\n<p>                  after serving two copies upon the learned counsel for the<\/p>\n<p>                  Housing Board on 25.11.2009, no counter affidavit has<\/p>\n<p>                  been filed by the Board till date.\n<\/p>\n<p>                              Learned counsel for the Board sought to make<\/p>\n<p>                  submissions from instructions he had received and<\/p>\n<p>                  sought leave to produce a document on behalf of the<\/p>\n<p>                  Board addressed to the petitioner which this Court<\/p>\n<p>                  permits him to do as no useful purpose is going to be<\/p>\n<p>                  served by insisting on a counter affidavit given the<\/p>\n<p>                  reluctance of the Board to file the same.<\/p>\n<p>                              The original relief sought was for possession<\/p>\n<p>                  of Plot No.H\/153 made by allotment No.854\/Aa dated<br \/>\n<span class=\"hidden_text\">                     -2-<\/span><\/p>\n<p>12.5.2006. A supplemental relief sought is for return of<\/p>\n<p>interest for the rest of the sixty monthly installments at<\/p>\n<p>the rate of 13.05% as also payment of Rs.92,500 forced to<\/p>\n<p>be borne by the petitioner for staying in private rental<\/p>\n<p>accommodation due to failure on the part of the<\/p>\n<p>respondents to give possession of the lands. Learned<\/p>\n<p>counsel submits that under the allotment agreement<\/p>\n<p>dated 12.5.2006 between the parties he fulfilled all<\/p>\n<p>conditions    required    of   him   notwithstanding    which<\/p>\n<p>possession was not being given.\n<\/p>\n<p>             Learned counsel for the Board produces a<\/p>\n<p>photo copy of a letter No.182 dated 16.3.2007 addressed<\/p>\n<p>to the petitioner for giving possession of Plot No.H\/153<\/p>\n<p>and submits that the Board is in a position to give free<\/p>\n<p>and vacant possession of the lands.\n<\/p>\n<p>             Learned counsel submits that once he has<\/p>\n<p>been offered possession on 16.3.2007, he is entitled to<\/p>\n<p>appropriate remissions in installments and\/or interest<\/p>\n<p>under the allotment agreement dated 12.5.2006.<\/p>\n<p>             The order dated 12.5.2006 is an allotment<\/p>\n<p>order and not one for giving possession of the plot which<\/p>\n<p>was subject to certain conditions. Which of the parties<\/p>\n<p>complied     the   condition   and   which   of   the   parties<\/p>\n<p>defaulted, is a question of fact. The consequences of<\/p>\n<p>default are also to be found in the agreement dated<br \/>\n<span class=\"hidden_text\">                     -3-<\/span><\/p>\n<p>12.5.2006. Likewise, there is no material before this<\/p>\n<p>Court to arrive at a finding how, when and in what<\/p>\n<p>manner the possession letter dated 16.3.2007 was<\/p>\n<p>delivered to the petitioner or not before its production in<\/p>\n<p>Court. On that may depend the liabilities under the<\/p>\n<p>allotment order dated 12.5.2006. After such liabilities are<\/p>\n<p>fixed, the consideration of the claims of the petitioner for<\/p>\n<p>refund of interest on amounts paid allegedly due to<\/p>\n<p>delayed possession may or may not arise.<\/p>\n<p>              The writ application is, therefore, disposed<\/p>\n<p>with liberty to the petitioner to file an application before<\/p>\n<p>the Price Fixation Committee of the Bihar State Housing<\/p>\n<p>Board along with a copy of the present order with all<\/p>\n<p>supportive materials in respect of his claims under the<\/p>\n<p>allotment dated 12.5.2006 and the conditions thereof<\/p>\n<p>read in conjunction with the letter of possession dated<\/p>\n<p>16.3.2007 to fix the respective liabilities of the parties.<\/p>\n<p>The Price Fixation Committee is expected to dispose of<\/p>\n<p>the matter expeditiously preferably within a maximum<\/p>\n<p>period   of      three    months   from    the    date    of<\/p>\n<p>receipt\/presentation of a copy of this order.<\/p>\n<p>              Needless to state that unless and until the<\/p>\n<p>Board does not hand over free and vacant possession to<\/p>\n<p>the petitioner in pursuance of the possession letter dated<\/p>\n<p>16.3.2007 the liabilities of the Board shall continue.<br \/>\n<span class=\"hidden_text\">                         -4-<\/span><\/p>\n<p>                  To obviate any further controversies, this<\/p>\n<p>     Court directs in presence of the learned counsel for the<\/p>\n<p>     parties that free and vacant possession of the land, as<\/p>\n<p>     offered by the Housing Board, shall be given to the<\/p>\n<p>     petitioner on the 14th of January, when the Executive<\/p>\n<p>     Engineer of the Board and the petitioner are directed to<\/p>\n<p>     remain present on the plot in question for the purpose at<\/p>\n<p>     11.00 a.m.<\/p>\n<p>                  Let the Xerox copy of the possession letter<\/p>\n<p>     dated 16.3.2007 placed during submissions be kept on<\/p>\n<p>     record and a photo copy of the same be furnished to the<\/p>\n<p>     counsel for the petitioner by the Court.<\/p>\n<p>                  The writ application stands disposed.\n<\/p>\n<\/p>\n<pre>KC                               ( Navin Sinha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Asha Kumari vs The State Of Bihar &amp;Amp; Ors on 2 December, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.16510 of 2009 1.
