PUBLIC PROSECUTOR for\nRespondent(s) : 1, \nNone for Respondent(s) :\n2, \n=========================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE MD SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/05\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\t Rule.\n<\/p>\n<p>Mr.L.R.Poojari, learned Additional Public Prosecutor and Mr.Harnish<br \/>\nDarji, learned advocate waive service of rule on behalf of<br \/>\nrespondent Nos.1 &#8211; State and 2 respectively.\n<\/p>\n<p>2.\t\tThe<br \/>\npresent application under Sec.482 of the Code of Criminal Procedure<br \/>\nhas been filed for quashing of complaint \/ FIR registered as<br \/>\nC.R.No.I-276 of 2010 before Vatva Police Station, Ahmedabad for the<br \/>\noffences punishable under Sections 365, 323 and  114  of Indian Penal<br \/>\nCode.\n<\/p>\n<p>3.\t\tHeard<br \/>\nMr.Chintan Popat, learned advocate for the applicant, Mr.L.R.Poojari,<br \/>\n learned Addl. Public Prosecutor for the respondent No.1 &#8211;<br \/>\nState and Mr.Harnish Darji, learned advocate for the respondent No.2.<br \/>\n  It is submitted by Mr.Popat, learned Advocate for the applicant<br \/>\nthat the matter is settled between the parties. It is submitted by<br \/>\nMr.Darji, learned Advocate for the respondent no.2 &#8211; original<br \/>\ncomplainant that in reference to business transaction and because of<br \/>\nsome misunderstanding, complaint was lodged by the original<br \/>\ncomplainant. Now the matter is settled and the original complainant<br \/>\nhas no grievance  against the applicant.  Original complainant is<br \/>\npresent before  the Court and he has also admitted that the matter is<br \/>\nsettled between the parties and at present also there is business<br \/>\ntransaction between the accused and original complainant. It is also<br \/>\nsubmitted by original complainant that settlement is not under any<br \/>\nduress and requested to quash the complaint.  Affidavit of the<br \/>\noriginal complainant is also produced on record.\n<\/p>\n<p>4.\t\tThe<br \/>\nApex Court in the case of Madan Mohan Abbot Vs. State of Punjab<br \/>\nreported in (2008)4  Supreme Court Cases page 582 has<br \/>\nobserved as under in paras 5 and<br \/>\n7 of the judgment:\n<\/p>\n<p>&#8220;5.\tIt<br \/>\nis on the basis of this compromise that the application was filed in<br \/>\nthe High Court for quashing of proceedings which  has been dismissed<br \/>\nby the impugned order.  We notice from a  reading of the FIR and the<br \/>\nother documents on record that the  dispute was purely a personal one<br \/>\nbetween two contesting  parties and that it arose out of extensive<br \/>\nbusiness dealings  between them and that there was absolutely no<br \/>\npublic policy  involved in the nature of the allegations made against<br \/>\nthe accused.   We are, therefore, of the opinion that no useful<br \/>\npurpose would be served in continuing with the proceedings in the<br \/>\nlight of the compromise and also in the light of the fact that the<br \/>\ncomplainant has, on 11th January 2004,  passed away and the<br \/>\npossibility of a conviction being recorded has thus to be ruled out.&#8221;\n<\/p>\n<p>&#8220;7.\n<\/p>\n<p>We see from the impugned order that the learned Judge has confused a<br \/>\ncompounding of an offence with the quashing of  proceedings.  The<br \/>\nouter limit of Rs.250\/- which has led to the dismissal of the<br \/>\napplication is an irrelevant factor in the later case.  We<br \/>\naccordingly allow the appeal and in the peculiar facts of the case,<br \/>\ndirect that  FIR No.155 dated 17th November 2001 P.S. Kotwali,<br \/>\nAmritsar and all proceedings connected therewith shall be deemed to<br \/>\nbe quashed.&#8221;\n<\/p>\n<p>5.\t\tConsidering<br \/>\naforesaid decision of the Hon&#8217;ble Supreme Court and settlement<br \/>\narrived between the parties, in opinion of this Court, no useful<br \/>\npurpose would be served in continuing with the criminal proceedings<br \/>\nand it will be harassment to the parties.  Hence, a case is made out<br \/>\nto exercise powers under section 482 of Criminal Procedure Code.\n<\/p>\n<p>6.\t\tIn<br \/>\nthe result, present application is allowed.  The complaint \/FIR<br \/>\nbeing C.R.No.I-276 of 2010 registered with Vatva Police Station,<br \/>\nAhmedabad and the proceedings therein are required to be quashed and<br \/>\nare accordingly quashed. Rule is made absolute to the aforesaid<br \/>\nextent.
