At the request of the learned<br \/>\ncounsel appearing for the parties, this application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under section 439 of the Code of Criminal<br \/>\nProcedure in connection with First Information Report registered as<br \/>\nCR No. I 231 of 2007 registered before Kanbha Police Station,<br \/>\nAhmedabad Rural for the offences punishable under Sections 302, 397,<br \/>\n201, 411 and 34 of the Indian Penal Code.\n<\/p>\n<p>3.\tMr<br \/>\nMM Tirmizi, learned advocate for the petitioner submitted that<br \/>\nconsidering the role attributed to the petitioner, it is a fit case<br \/>\nto release the petitioner on bail.  He submitted that the petitioner<br \/>\nwas denied bail by the learned Additional Sessions Judge because some<br \/>\nstolen goods were found from the petitioner.  Learned advocate for<br \/>\nthe petitioner submitted that there is no other material to rope in<br \/>\nthe petitioner in connection with the offence, and, therefore, the<br \/>\nprayer as set out may kindly be granted.\n<\/p>\n<p>4.\tOn<br \/>\nthe other hand, learned Additional Public Prosecutor, Ms Manisha<br \/>\nShah, relying on the FIR at Annexure &#8216;A&#8217; and the order dated<br \/>\n19.06.2008 passed by the learned Additional Sessions Judge, Fast<br \/>\nTrack Court No.7, Ahmedabad Rural in Criminal Misc. Application No.<br \/>\n638 of 2008 submitted that the petitioner is involved in serious<br \/>\noffences and considering the nature of the offences and the manner in<br \/>\nwhich the petitioner is involved in the said offences, the<br \/>\napplication deserves to be rejected.\n<\/p>\n<p>5.\tAfter<br \/>\nconsidering the rival submissions and on perusal of the FIR as well<br \/>\nas the order passed by learned Additional Sessions Judge in Criminal<br \/>\nMisc. Application No. 638 of 2008, the petitioner is booked for<br \/>\noffences punishable under Sections 302, 397, 201, 411 and 34 of the<br \/>\nIndian Penal Code. Considering the role attributed to the petitioner,<br \/>\nprima facie, the petitioner was not directly involved in the<br \/>\ncommission of offences and he was found in possession of some stolen<br \/>\ngoods.  Reading the FIR, save and except the aforesaid role, no other<br \/>\nrole can be prima facie attributed to the petitioner.  In view of the<br \/>\nabove, considering the peculiar facts and circumstances of the case<br \/>\nand the role attributed to the petitioner, I am of the view that the<br \/>\npetitioner is required to be enlarged on regular bail at this stage,<br \/>\nwithout entering into the merits of the case and  without discussing<br \/>\nthe evidence in detail.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the petition is allowed and<br \/>\nthe petitioner is ordered to be enlarged on bail in connection with<br \/>\nCR No. I 231 of 2007 registered before Kanbha Police Station,<br \/>\nAhmedabad Rural on executing a bond of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] with one surety of the like amount to the satisfaction<br \/>\nof the Trial Court and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender<br \/>\nhis passport, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e].\tmark<br \/>\nhis presence at the concerned police station on any day of every<br \/>\nfirst week of English calendar month between 9.00 AM and 2.00 PM.<br \/>\ntill the trial is over;\n<\/p>\n<p>[f].\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>9.\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the petitioner on bail.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>\tDirect<br \/>\nService is permitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\t(H.B.\n<\/p>\n<p>Antani, J.)<\/p>\n<p>mrpandya*<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Imrankhan vs State on 1 August, 2008 Author: H.B.Antani,&amp;Nbsp;
