Application.\n<\/p>\n<p>Heard<br \/>\n\tMr. Vakharia learned Counsel for the petitioner and Mr. LR Pujari<br \/>\n\tlearned APP for the State Authority.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, as it appears that the chargesheet is<br \/>\n\tfiled and the matter is pending before the concerned Criminal Court,<br \/>\n\tthe petitioner will have to mark presence, at the time of trial<br \/>\n\tbefore the concerned Court, and therefore condition No. 19(d) may<br \/>\n\tnot be required. So far as the condition No. 16(e) is concerned, it<br \/>\n\thas been submitted by the learned Counsel for the petitioner that<br \/>\n\tthe petitioner may be required to go outside the State of Gujarat<br \/>\n\tfor business purpose and therefore, in view of the existing<br \/>\n\tcondition it is causing hardship.\n<\/p>\n<p>Considering<br \/>\n\tthe facts and circumstances, as the trial is pending, such condition<br \/>\n\tcan be modified to the effect that as and when the petitioner is<br \/>\n\trequired to leave the State of Gujarat, he may be required to inform<br \/>\n\tthe concerned Police Station, the place he is to stay outside the<br \/>\n\tState of Gujarat and after he comes back from the said place and he<br \/>\n\tis available in State of Gujarat can also be informed to the<br \/>\n\tconcerned Police Station. The aforesaid would ensure his presence,<br \/>\n\tand also movement, if at all required to control at the appropriate<br \/>\n\tstage.\n<\/p>\n<p>In<br \/>\n\tview of the above, earlier order dated 25.3.2004-15.04.2004 passed<br \/>\n\tby this Court is modified to the effect that the petitioner shall<br \/>\n\tnot be required to mark presence before the concerned police station<br \/>\n\tas per condition No. 19(d), but shall remain present at the time of<br \/>\n\ttrial before the trial Court.\n<\/p>\n<p>Further,<br \/>\n\tcondition No. 19(e) shall get substituted by the condition that as<br \/>\n\tand when the petitioner has to leave State of Gujarat, he shall<br \/>\n\tinform the place to the concerned Police Station, at which he is<br \/>\n\tgoing to stay outside the State of Gujarat and after such<br \/>\n\tintimation, he shall be at the liberty to go outside the State of<br \/>\n\tGujarat and further after the petitioner enters the State of<br \/>\n\tGujarat, the same shall also be intimated to the concerned Police<br \/>\n\tStation.\n<\/p>\n<p>All<br \/>\n\tthe applications are allowed to the aforesaid extent.
