Mr. KC Shah, learned APP appears for and waives<br \/>\n\tservice of notice of rule on behalf of the respondent No.2. In the<br \/>\n\tpeculiar facts of the case, all the parties jointly request that the<br \/>\n\tapplication may be taken up for final hearing today and may be<br \/>\n\tdecided finally today. Thus, with the consent of the learned<br \/>\n\tadvocates appearing on behalf of the respective parties and in view<br \/>\n\tof the joint request, present application is taken up for hearing<br \/>\n\ttoday.\n<\/p>\n<p>The<br \/>\n\tapplicant herein has preferred this application against an order<br \/>\n\tdated 22.2.2008 whereby, the appeal No.8 of 2005 came to be<br \/>\n\tdismissed for default on account of absence of the appellant.<br \/>\n\tAgainst the said order dated 22.2.2008 present revision application<br \/>\n\tis preferred. By the same order the learned Court has, the counsel<br \/>\n\tpoint out, also disposed off companion matter being revision<br \/>\n\tapplication No.78 of 2006 and the concerned applicant has preferred<br \/>\n\tcriminal revision application No.330 of 2008 against the order.\n<\/p>\n<p>It<br \/>\n\tis, by now, settled position that appeal ought not to be dismissed<br \/>\n\tfor default for non-prosecution. Mr. Parikh has appeared for the<br \/>\n\tapplicant and submitted that the said order is unjust and untenable.<br \/>\n\tMr. Parikh has placed reliance on the judgment of the Hon&#8217;ble Apex<br \/>\n\tCourt in the case of Parasuram Patel &amp; Anr. V\/s. State of<br \/>\n\tOrissa reported in (1994) 4 SCC 664 wherein,<br \/>\n\tthe Hon&#8217;ble Apex Court has held that ?Sit is now well settled<br \/>\n\tthat no criminal appeal can be dismissed on the ground of default in<br \/>\n\tappearance.??\n<\/p>\n<p>\tIn<br \/>\n\tview of the said judgment of the Hon&#8217;ble Apex Court, the impugned<br \/>\n\torder dated 22.2.2008 is quashed and set aside. The District Court,<br \/>\n\tAmreli is directed to restore the appeal No.8 of 2005 to file and to<br \/>\n\trestore the proceedings and to proceed with the hearing in<br \/>\n\taccordance with law.\n<\/p>\n<p>\tWith<br \/>\n\tthe aforesaid observation and direction, present application is<br \/>\n\tallowed. Rule made absolute to the aforesaid extent.
