ABDUL REHIM, J.\n              - - - - - - - - - - - - - - - - - - - - - - -\n                 W.P.(C)No. 29375 of 2009\n              - - - - - - - - - - - - - - - - - - - - - - -\n          Dated this the 6th day of November, 2009\n\n                        J U D G M E N T\n<\/pre>\n<p>     1.   Petitioners are widow and children of a deceased<\/p>\n<p>person who had availed a loan from the 2nd respondent<\/p>\n<p>Bank, in the year 2005, to the tune of Rs.6 lakhs.<\/p>\n<p>Petitioners are now aggrieved by the coercive steps<\/p>\n<p>threatened against the immovable property which is<\/p>\n<p>mortgaged for securing the loan. Consequent to default<\/p>\n<p>committed in repayment, the respondents had initiated<\/p>\n<p>proceedings under the Securitization and Reconstruction of<\/p>\n<p>Financial Assets and Enforcement of Security Interest Act,<\/p>\n<p>2002 (SARFAESI Act) and steps are being pursued to take<\/p>\n<p>over possession of the immovable property. According to<\/p>\n<p>the petitioners the untimely death of the husband of the 1st<\/p>\n<p>petitioner had put them into stringent financial position and<\/p>\n<p>they had expended huge amount with respect to his<\/p>\n<p>treatment.     However the petitioners are expressing<\/p>\n<p>W.P.(C)No. 29375 of 2009<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>willingness to pay off the defaulted installments and to<\/p>\n<p>regularise the loan account.\n<\/p>\n<p>      2.    Learned standing counsel appearing for the<\/p>\n<p>respondents on the basis of instructions submitted that the<\/p>\n<p>amount pertaining to the defaulted installments along with<\/p>\n<p>interest and expenses outstanding as on today will be<\/p>\n<p>around Rs.2 lakhs.\n<\/p>\n<p>      3.    Considering the facts and circumstances of the<\/p>\n<p>case, I am of the opinion that some indulgence can be<\/p>\n<p>shown in the matter of permitting the petitioners to pay off<\/p>\n<p>the arrears in the loan account and to continue repayment<\/p>\n<p>as per the original schedule.\n<\/p>\n<p>      4.    Accordingly the writ petition is disposed of<\/p>\n<p>directing the petitioners to make payment of the entire<\/p>\n<p>amounts pertaining to the defaulted installments along with<\/p>\n<p>interest over due and expenses if any liable, in five (5) equal<\/p>\n<p>monthly installments falling due on or before 15.12.2009<\/p>\n<p>and on or before the 15th day of the succeeding four (4)<\/p>\n<p>months. The petitioners shall make payment of the regular<\/p>\n<p>W.P.(C)No. 29375 of 2009<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>installments due from December 2009 onwards, along with<\/p>\n<p>the above said payment. In case the amount as stipulated<\/p>\n<p>as above is paid without any default the respondents shall<\/p>\n<p>permit the petitioners to continue future repayments as per<\/p>\n<p>the original schedule.\n<\/p>\n<p>      5.    It is made clear that on the event of failure to pay<\/p>\n<p>any of the installments as stipulated as above, the<\/p>\n<p>respondents will be free to proceed with further steps<\/p>\n<p>pursuant to the notices already issued and on such event<\/p>\n<p>the petitioners are precluded from raising any further<\/p>\n<p>challenge against such proceedings either before this court<\/p>\n<p>or before any other forum.\n<\/p>\n<\/p>\n<p>                                          C.K.
