             The   petitioner   is   accused   in   C.C.No.1291\/2005<\/p>\n
on   the   file   of   the   Judicial   Magistrate   of   First   Class-I,<\/p>\n
Karunagappally, for the offence punishable under Section<\/p>\n
420   IPC.        The   petitioner   was   arrested   in   crime<\/p>\n
No.170\/2006            of          Vattiyoorkavu             police         station,<\/p>\n
Thiruvananthapuram, on 30.7.2006.  As C.C.No.1291\/2005<\/p>\n
had   originated   basing   on   crime   No.102\/CR\/KLM\/04   of<\/p>\n
CBCID, Kollam,   the arrest of the petitioner was recorded<\/p>\n
by   the   Investigating   Officer   in   that   crime   on   22.9.2006.<\/p>\n
The   petitioner   is   before   this   Court,   for   an   order   under<\/p>\n
Section   439   Cr.P.C,   in   CBCID   crime   at   Kollam,   on   the<\/p>\n
ground that he is already on bail in crime No.170\/2006 of<\/p>\n
Vattiyoorkavu Police Station.\n<\/p>\n<\/p>\n
      2.     The   learned   counsel   for   the   petitioner<\/p>\n
submitted that the petitioner was only a middle man.    He<\/p>\n
received  money  and arranged visa and travel  documents,<\/p>\n
with   the     money   that   had   been   received   through   some<\/p>\n
other persons   abroad.     The petitioner had already sold<\/p>\n
out   his   property   and   arranged   re-payment   to   few<\/p>\n
persons.  The petitioner has two daughters  of which, one<\/p>\n
alone is married and other girl is with him.  His wife had<\/p>\n
divorced   him   after   the   mishap   that   occurred   to   the<\/p>\n
petitioner.     He   is   a   chronic     diabetic   patient,   being<\/p>\n
treated   for the last six years.   The petitioner is not able<\/p>\n
to   immediately   meet   the   demand   of   the   complainant.<\/p>\n
Therefore, prayed that he may be granted bail.<\/p>\n
      3.       The   learned   Public   Prosecutor,   on   the   other<\/p>\n
hand, submitted that the investigation is complete.   The<\/p>\n
petitioner   had   cheated   14   persons,   though   only   four<\/p>\n
cases had been registered so far.       If the amount is not<\/p>\n
paid back, the complainant would be put into difficulties.<\/p>\n
The   sickness   of   the   petitioner   would   be   attended   to   by<\/p>\n
the   jail   authorities,     as   and   when       any   such   situation<\/p>\n
arises, as the health of the petitioner is now reported to<\/p>\n
be normal.    The  prosecution  is prepared to immediately<\/p>\n
start   the   trial   and     complete   it   at   the   earliest   and<\/p>\n
therefore,   opposed   the   granting   of   the   bail   to   the<\/p>\n
petitioner.\n<\/p>\n<\/p>\n
        4.    Without   entering   into   any   discussion   on   the<\/p>\n
merit  of the  matter,   as the  investigation  in  this case is<\/p>\n
complete   and   the   prosecution   is   prepared   to   complete<\/p>\n
the   trial,     I   direct   the   prosecution   to   immediately   take<\/p>\n
steps   to   produce   the   witnesses,   as   per   the   schedule,<\/p>\n
before the Court below and the learned Magistrate shall<\/p>\n
ensure that the case is taken up with priority and finally<\/p>\n
dispose   of   as   early   as   possible,   in   any   case   within   two<\/p>\n
months from today, as the petitioner is in jail.<\/p>\n
        5.    I also direct the jail authorities to give all the<\/p>\n
required   medical   attendance   to   the   petitioner   for<\/p>\n
continuing   his   treatment   for   diabetics,   which   he   is<\/p>\n
alleged to be suffering.\n<\/p>\n<\/p>\n
        6.    Immediately send the copy of the order to the<\/p>\n
Court below.\n<\/p>\n<\/p>\n
              The application is disposed of as above.<\/p>\n

                              O R D E R<\/p>\n
                    The request of the Judicial Magistrate of<\/p>\n
First   Class,   Karunagappally,   for   further   extension     of<\/p>\n
time   of   three   months   was   considered.     The   bail   was<\/p>\n
denied to the accused, after considering the submissions<\/p>\n
made   by   the   prosecution.     The   trial   was   directed   to   be<\/p>\n
expedited   and   prosecution   undertook   that   they   would<\/p>\n
produce all the witnesses.\n<\/p>\n<\/p>\n
             2.     The   request   of   the   learned   Magistrate<\/p>\n
dated 24.11.2006  is that he is not able to dispose of the<\/p>\n
case,   because   of   the   pressure   of   work   and   pendency   of<\/p>\n
the cases in his Court.  That is not in any way the ground<\/p>\n
for not disposing of the matter,  when a specific direction<\/p>\n
is   given   by   this   Court.     Therefore,   I   express   my<\/p>\n
displeasure  on the conduct of the learned Magistrate.  In<\/p>\n
order to avoid any adverse remark on his judicial career,<\/p>\n
I  refrain  from making further  observations.   However, I<\/p>\n
grant an extension of time requested   for by the learned<\/p>\n
Magistrate.\n<\/p>\n<\/p>\n
             3.     In the above facts situation, the accused,<\/p>\n
whose   bail   had   been   denied,   as   per   the   order   of   this<\/p>\n
Court dated 17.10.2006, shall approach the Court below<\/p>\n
with an application for bail, in that event, the  Magistrate<\/p>\n
shall allow him to be on bail,   imposing such conditions,<\/p>\n
as are deemed necessary.\n<\/p>\n<\/p>\n
