{"id":201960,"date":"2011-06-30T00:00:00","date_gmt":"2011-06-29T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/panchiben-vs-safibhai-on-30-june-2011"},"modified":"2016-08-29T15:23:56","modified_gmt":"2016-08-29T09:53:56","slug":"panchiben-vs-safibhai-on-30-june-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/panchiben-vs-safibhai-on-30-june-2011","title":{"rendered":"Panchiben vs Safibhai on 30 June, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Panchiben vs Safibhai on 30 June, 2011<\/div>\n<div class=\"doc_author\">Author: Rajesh H.Shukla,<\/div>\n<pre>  \n Gujarat High Court Case Information System \n    \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nSCA\/7992\/2011\t 2\/ 2\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 7992 of 2011\n \n\n \n \n=========================================\n\n\n \n\nPANCHIBEN\nPANCHABHAI BHALIYA - Petitioner(s)\n \n\nVersus\n \n\nSAFIBHAI\nDAUDBHAI MANSURI - Respondent(s)\n \n\n=========================================\n \nAppearance : \nMR\nMANOJ SHRIMALI for Petitioner(s) : 1, \nNone for Respondent(s) :\n1, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 30\/06\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent petition has been filed by the Petitioner under Articles 14,<br \/>\n\t19, 21, 226 and 227 of the Constitution of India as well as under<br \/>\n\tthe Code of Civil Procedure for the prayer that appropriate writ,<br \/>\n\torder or direction may be issued quashing and setting aside the<br \/>\n\timpugned order dated 21.1.2011 passed by the learned additional<br \/>\n\tDistrict Judge and Fast Track Court, Veraval, Camp at Una in Misc.<br \/>\n\tCivil Appeal No.21 of 2010 to the extent of stay against putting up<br \/>\n\tfencing by the Petitioner, on the grounds set out in the petition.\n<\/p>\n<p>Heard<br \/>\n\tlearned Advocate Mr. Manoj Shrimali appearing for the petitioner and<br \/>\n\tperused the papers.\n<\/p>\n<p>As<br \/>\n\tit transpires from the observations made by the lower appellate<br \/>\n\tcourt on page 36-37, there is no measurement and demarcation of the<br \/>\n\tarea, and therefore, as observed by the lower appellate court to<br \/>\n\tavoid the confusion that part has been modified from the order by<br \/>\n\tthe trial court granting injunction which does not call for any<br \/>\n\tinterference.\n<\/p>\n<p>Learned<br \/>\n\tAdvocate Mr. Shrimali submitted that let the DLR make the<br \/>\n\tmeasurement with regard to the land in question for the purpose of<br \/>\n\tboundaries, and on the basis of such measurement and the report of<br \/>\n\tthe DLR, the application would be made before the trial court which<br \/>\n\tmay be decided after hearing both the sides.\n<\/p>\n<p>Accordingly,<br \/>\n\tthe present petition stands disposed of with the direction that the<br \/>\n\tDLR shall make the measurement and make the panchnama with the<br \/>\n\treport about the boundaries in presence of both the sides.  The<br \/>\n\tnecessary application which may be made to the trial court by the<br \/>\n\tpetitioner would be considered by the trial court in accordance with<br \/>\n\tthe report of the DLR and the measurement made with regard to the<br \/>\n\tboundaries, the same may be decided expeditiously.\n<\/p>\n<p>With<br \/>\n\tthe aforesaid observation, the present petition stands disposed of.\n<\/p>\n<p>(Rajesh<br \/>\nH.
