SANKARAN, J.\n                    ---------------------------\n                     B.A. No. 560 of 2010\n               ------------------------------------\n            Dated this the 15th day of March, 2010\n\n                           O R D E R\n<\/pre>\n<p>    When the Bail Application came up for hearing on<\/p>\n<p>25\/02\/2010, the following order was passed:<\/p>\n<blockquote><p>          &#8220;This is an application for anticipatory bail under<\/p>\n<p>    Section 438 of the Code of Criminal Procedure. The<\/p>\n<p>    petitioner is accused No.4 in Crime No.522 of 2009 of<\/p>\n<p>    Kaduthuruthy Police Station, Kottayam District.<\/p>\n<\/blockquote>\n<blockquote><p>          2. The offence alleged against the petitioner is<\/p>\n<p>    under Section 394 of the Indian Penal Code.<\/p>\n<\/blockquote>\n<blockquote><p>          3.   The gist of the prosecution case is the<\/p>\n<p>    following: On 18.11.2009, the accused persons were<\/p>\n<p>    travelling in a car. An accident occurred when the car<\/p>\n<p>    collided with a lorry driven by the de facto<\/p>\n<p>    complainant. It is alleged that the accused persons<\/p>\n<p>    attacked the de facto complainant and took away his<\/p>\n<p>    purse containing Rs.4,700\/-, a mobile phone and<\/p>\n<p>    driving licence. The petitioner apprehends arrest.<\/p><\/blockquote>\n<p>          4.   Taking    into   account    the   facts   and<\/p>\n<p>    circumstances of the case, I am of the view that<\/p>\n<p>    before    disposing   of   the   Bail   Application,  an<\/p>\n<p>    opportunity should be given to the petitioner to<\/p>\n<p>    appear before the investigating officer. Accordingly,<\/p>\n<p>    there will be a direction to the petitioner to appear<\/p>\n<p>B.A. No. 560 \/2010<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>      before the investigating officer at 9 AM on 4th and 5th<\/p>\n<p>      March, 2010. The petitioner shall produce a copy of<\/p>\n<p>      the order before the investigating officer.<\/p>\n<p>             5. Post on 15th March, 2010.\n<\/p>\n<p>             It is submitted by the learned Public Prosecutor<\/p>\n<p>      that the petitioner will not be arrested until further<\/p>\n<p>      orders in connection with Crime No.522 of 2009 of<\/p>\n<p>      Kaduthuruthy Police Station, Kottayam District. &#8221;<\/p>\n<p>      2.     It is submitted by the learned counsel for the<\/p>\n<p>petitioner as well as the learned Public Prosecutor that the<\/p>\n<p>petitioner has complied with the direction contained in the order<\/p>\n<p>dated 25\/02\/2010.\n<\/p>\n<p>      3.     Taking into account the facts and circumstances of the<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner.<\/p>\n<p>There will be a direction that in the event of the arrest of the<\/p>\n<p>petitioner, the officer in charge of the police station shall release<\/p>\n<p>him on bail on his executing bond for Rs.15,000\/- with two<\/p>\n<p>solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioner shall       report      before     the<br \/>\n              investigating officer between 9 A.M and 11 A.M.<br \/>\n              on alternate Mondays, till the final report is filed<br \/>\n              or until further orders;\n<\/p><\/blockquote>\n<p>B.A. No. 560 \/2010<br \/>\n<span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>         B) The      petitioner  shall    appear    before     the<br \/>\n              investigating officer for interrogation as and<br \/>\n              when required;\n<\/p>\n<p>         C) The petitioner shall not try to influence the<br \/>\n              prosecution   witnesses    or  tamper     with   the<br \/>\n              evidence;\n<\/p>\n<p>         D) The petitioner shall not commit any offence or<br \/>\n              indulge in any prejudicial activity while on bail;<\/p>\n<p>         E) In case of breach of any of the conditions<br \/>\n              mentioned above, the bail shall be liable to be<br \/>\n              cancelled.\n<\/p>\n<p>       The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                       K.T.
