SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/05\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\t\tPresent<br \/>\nApplication has been submitted by the applicant herein   original<br \/>\ndefendant to quash and set aside order passed by the learned<br \/>\nPrincipal District Judge, Ahmedabad (Rural) passed in Misc. Civil<br \/>\nApplication No.55 of 2009 below Exh.12 and to direct learned<br \/>\nPrincipal District Judge to extend the time limit to deposit the<br \/>\narrears of rent.\n<\/p>\n<p>2.\t\tAt<br \/>\nthe outset it is required to be noted that petitioner herein<br \/>\noriginal defendant preferred Civil Revision Application No.287 of<br \/>\n2009 before this Court challenging the order dated 26.08.2009 passed<br \/>\nby the learned Principal District Judge, Ahmedabad (Rural) in<br \/>\nMisc.Civil Application No.55 of 2009 in dismissing the said<br \/>\napplication having been abated.  That this Court vide judgment and<br \/>\norder dated 30.12.2009 allowed the said Revision Application by<br \/>\nquashing and setting aside the impugned order passed by the learned<br \/>\nAppellate Court in Misc. Civil Application No.55 of 2009 and directed<br \/>\nthe Appellate Court to decide and dispose of the appeal afresh in<br \/>\naccordance with law and on merits.  At that time it was submitted on<br \/>\nbehalf of the respondent   heirs of original plaintiff that huge<br \/>\namount of Rs.95,000\/- was due and payable towards arrears of rent and<br \/>\nthe petitioner has paid only Rs.5,000\/-. It was requested to direct<br \/>\nthe petitioner to deposit \/ pay arrears of rent and considering the<br \/>\nUndertaking submitted by the learned Advocate for the petitioner that<br \/>\nshe will deposit an amount of Rs.95,000\/- towards arrears of rent of<br \/>\nsuit premises by making part payment of Rs.50,000\/- within a period<br \/>\nof two months from 30.12.2009 and remaining amount in installment of<br \/>\nRs.5,000\/- every month before the learned Appellate Court and shall<br \/>\npay regular monthly rent as and when due and payable, this Court<br \/>\nallowed the said Revision Application vide order dated 30.12.2009 by<br \/>\nissuing following directions in para -9 :-\n<\/p>\n<p> 9.\t\tFor<br \/>\nthe reasons stated hereinabove, the present Civil Revision<br \/>\nApplication is allowed. The impugned order passed by learned District<br \/>\nCourt, Ahmedabad (Rural) dated 26\/08\/2009 passed in Misc.Civil<br \/>\nApplication No.55 of 2009 is hereby quashed and set aside and the<br \/>\npetitioner is granted two months time to pay the Court fees, as<br \/>\nrequired to be paid in the Appeal challenging the judgement and<br \/>\ndecree passed by learned Principal Civil Judge (J.D.), Ahmedabad<br \/>\ndated 21\/01\/2008 in Regular Civil Suit No.735 of 2003 and on payment<br \/>\nof Court fees, learned Principal District Judge, Ahmedabad (Rural)<br \/>\ni.e Appellate Court is hereby directed to consider the Appeal<br \/>\npreferred by the petitioner against the aforesaid judgement and order<br \/>\npassed in Regular Civil Suit No.735 of 2003 on merits. In the<br \/>\nmeantime, the petitioner is directed to act as per undertaking filed<br \/>\nbefore this Court dated 30\/12\/2009 and shall make part payment of<br \/>\nRs.50,000\/- towards arrears of rent  before learned District Court,<br \/>\nAhmedabad (Rural) within a period of two months from today and<br \/>\nremaining amount towards arrears of rent, she shall deposit with the<br \/>\nAppellate Court by monthly installment of Rs.5,000\/- and shall<br \/>\ncontinue to pay monthly rent as and when due and payable. On such<br \/>\ndeposit, it will be open for the respondent to withdraw the same<br \/>\nwithout prejudice to the rights and contentions of the respective<br \/>\nparties and subject to the ultimate outcome of the appeal before<br \/>\nlearned District Court, Ahmedabad (Rural). Till the Appeal is<br \/>\ndecided, there shall be stay of further implementation and operation<br \/>\nof the judgement and decree dated 21\/01\/2008 passed by learned<br \/>\nPrincipal Civil Judge (J.D.), Ahmedabad (Rural) in Regular Civil Suit<br \/>\nNo.735 of 2003.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>3.\t\tIt<br \/>\nappears that despite aforesaid Undertaking and order passed by this<br \/>\nCourt, applicant herein did not deposit arrears of rent and instead<br \/>\nsubmitted application before the District Court to extend time to pay<br \/>\narrears of rent as directed by this Court (though said application<br \/>\nwas not maintainable before the District Court as order to pay<br \/>\narrears of rent was passed by this Court) and during the pendency of<br \/>\nsaid application applicant herein has preferred present application<br \/>\nbefore this Court to direct learned Principal District Judge to<br \/>\nextend time limit to deposit arrears of rent.\n<\/p>\n<p>4.\t\tHaving<br \/>\nheard learned Advocates appearing for the respective parties and<br \/>\nconsidering the fact that despite Undertaking and order passed by<br \/>\nthis Court, applicant herein has not deposited arrears of rent which<br \/>\nis due and payable since many years and even conduct on the part of<br \/>\nthe applicant to approach District Court to extend time (though such<br \/>\napplication before the District Court was not maintainable as order<br \/>\nto deposit arrears of rent was passed by this Court), present<br \/>\napplication deserves to be dismissed. It cannot be said that learned<br \/>\nPrincipal District Judge has committed any error in not extending<br \/>\ntime to deposit arrears of rent.
