Justice R.BASANT\n\n Dated :26\/06\/2007\n\n O R D E R\n                                     R.BASANT, J\n\n                          ------------------------------------\n\n                            Crl.M.C.No.2032 of 2007\n\n                          -------------------------------------\n\n                     Dated this the 26th  day of June, 2007\n\n\n                                       O R D E R\n<\/pre>\n<p>         Petitioners   face   indictment   for   an   offence   punishable   uinder<\/p>\n<p>Section   56(b)   of   the   Kerala   Abkari   Act.     Final   report   has   been   filed.<\/p>\n<p>For   obscure   reasons   proceedings   are   seen   registered   as   committal<\/p>\n<p>proceedings.     The   petitioners   have   come   before   this   Colurt   to   raise<\/p>\n<p>two   grievances.     It   is   contended   first   of   all   that   no   committal<\/p>\n<p>proceedings   are,   at   any   rate,   liable   to   be   registered.     Secondly   it   is<\/p>\n<p>contended that cognizance taken is barred by limitation.   I am of the<\/p>\n<p>opinion that the petitioners must raise both these contentions before<\/p>\n<p>the   learned   Magistrate.     The   learned   Magistrate   must   expeditiously<\/p>\n<p>consider those contentions and pass appropriate orders.  I do not find<\/p>\n<p>any  necessity  for this  Court to invoke  the  powers  under  Section 482<\/p>\n<p>Cr.P.C     for   considering   the   said   contentions.     The   petitioners   must<\/p>\n<p>raise them before the learned Magistrate and the learned Magistrate<\/p>\n<p>must pass appropriate orders.\n<\/p>\n<\/p>\n<p>         2.
