Civil Application No. 3056 of 2003\n          MS SONA SAGAR for Petitioner No. 1\n          MR JV JAPEE for Respondent No. 1\n\n\n     --------------------------------------------------------------\n\n\n                CORAM : MR.JUSTICE H.K.RATHOD\n\n\n                Date of Order: 02\/05\/2003\n\n\nORAL ORDER<\/pre>\n<p>     1.Heard learned advocate Ms.Sona Sagar appearing on<br \/>\n     behalf of the applicant &#8211; original respondent No.2 and<br \/>\n     learned advocate Mr.J.V.Japee appearing on behalf of the<br \/>\n     opponent &#8211; original petitioner.\n<\/p>\n<p>     2.In a main writ petition being Special Civil<br \/>\n     Application No.9042 \/ 2002, the original petitioner has<br \/>\n     challenged two orders passed by the Industrial Tribunal,<br \/>\n     Surat viz.    the order passed by the Industrial Tribunal<br \/>\n     in Reference No.9 \/ 1995 dated 31st December, 1998<br \/>\n     wherein the Industrial Tribunal, Surat has directed the<br \/>\n     employer to lift lock out with effect from 25th November,<br \/>\n     1992 and to give work and reinstate all the respondent<br \/>\n     workmen and also to pay full wages with effect from 25th<br \/>\n     November, 1992 till the the workmen        are   actually<br \/>\n     reinstated in service. This order has been passed by the<br \/>\n     Industrial Tribunal, Surat exparte in absence of the<br \/>\n     petitioner and therefore petitioner has approached the<br \/>\n     Industrial Tribunal by way of Miscellaneous Application<br \/>\n     No.1\/1999 in Reference No.9\/1999. That said application<br \/>\n     has been rejected by the Industrial Tribunal, Surat on<br \/>\n     29th September, 2000 and that is how the challenge made<br \/>\n by the petitioner before this Court challenging the<br \/>\nexparte award passed by the Tribunal as well as the order<br \/>\npassed by the     Industrial   Tribunal   rejecting   the<br \/>\napplication for setting aside the exparte award.\n<\/p>\n<p>3.This Court has issued RULE and granted ad-interim<br \/>\nrelief in terms of para-12[B] vide order dated 7th<br \/>\nOctober, 2002 and on account of the grant of interim<br \/>\nrelief granted by this Court, reinstatement of the<br \/>\nrespondents workmen has been stayed.    Learned advocate<br \/>\nMs.Sona Sagar has submitted that the dispute was raised<br \/>\nby the Union relating to 79 workmen those who are out of<br \/>\njob on account of illegal lock out declared by the<br \/>\nemployer. In view of this fact, when reinstatement has<br \/>\nbeen stayed by this Court, present application is filed<br \/>\nby the respondent with a prayer to vacate the ad-interim<br \/>\nrelief granted by this Court on 7th October, 2002. Over<br \/>\nand above the written reliefs as prayed for in the<br \/>\npresent civil application, learned advocate Ms.Sagar<br \/>\norally suggests that if this Court is not inclined to<br \/>\nvacate ad-interim relief granted earlier by this Court<br \/>\nafter giving by-parte hearing at this stage, in such<br \/>\neventuality, this Court may grant benefits under Section<br \/>\n17-B of the I.D.Act to all the concerned workmen from the<br \/>\ndate of award as they are out of job on account of<br \/>\nillegal lock out declared by the employer. She also<br \/>\nundertakes that the workmen concerned who are unemployed<br \/>\nand   not gainfully employed, will individually file<br \/>\nnecessary affidavit as required under Section 17-B of the<br \/>\nI.D.Act, 1947.\n<\/p>\n<p>4.Learned advocate Mr.Japee appearing on behalf of<br \/>\nthe original petitioner wants some time to file detailed<br \/>\nreply against the present civil application on the ground<br \/>\nthat he received a copy of this civil application<br \/>\nyesterday only and further pleaded that since his client<br \/>\nis at Surat, he needs some instructions from his client<br \/>\nand therefore, this matter may be adjourned for couple of<br \/>\ndays. However, the request made by the learned advcoate<br \/>\nMr.Japee is not acceded to by this Court on the ground<br \/>\nthat at this stage this Court is not inclined to hear<br \/>\nthis matter for vacating the ad-interim relief granted by<br \/>\nthis Court on date date 7th October, 2002 by giving<br \/>\nby-parte hearing, but this Court, at this stage, only<br \/>\nconsiders the aspect of grant of benefits to the original<br \/>\nrespondent workmen under Section 17-B of the I.D.Act,<br \/>\n1947. However, learned advocate Mr.Japee contended that<br \/>\nthis is not illegal lock out declared by the petitioner.<br \/>\nBut this contention is not dealt with at this stage on<br \/>\nmerits as this Court in not hearing the main issue<br \/>\ninvolved in this petition and the same will be considered<br \/>\n at the time of final hearing of this petition.\n<\/p>\n<p>5.It may be appreciated that       the   Industrial<br \/>\nTribunal, Surat has in its award directed the employer to<br \/>\nlift lock out with effect from 25th November, 1992 and to<br \/>\ngive work and reinstate all the respondent workmen and<br \/>\nalso to pay full wages with effect from 25th November,<br \/>\n1992 till the the workmen are actually reinstated in<br \/>\nservice but since this Court granted ad-interim relief in<br \/>\nfavour of the original petitioner, operation of award in<br \/>\nfavour of the respondents workmen has been stayed by this<br \/>\nCourt, meaning thereby, provisions of Section 17-B of the<br \/>\nI.D.Act become operative and the said provisions being<br \/>\nthe mandatory provision, the same are required to be<br \/>\ncomplied with by the employer.\n<\/p>\n<p>6.This Court has also considered the submissions of<br \/>\nthe learned advocate Ms.Sagar that the workmen 79 in<br \/>\nnumber, who are jobless since 1992 on account of illegal<br \/>\nlock out declared by the original petitioner as held by<br \/>\nthe industrial tribunal and resultantly, all the workmen<br \/>\nare facing hardships to survive in these days.\n<\/p>\n<p>7.This Court, without considering the merits of the<br \/>\nmatter, that will be considered at the time of final<br \/>\nhearing, at this stage of the view that all the workmen<br \/>\nare entitled to benefits of Section 17-B of the I.D.Act,<br \/>\n1947.     Therefore,   it is directed to the original<br \/>\npetitioner to the respondent workmen concerned the pay<br \/>\nlast   drawn    monthly wages inclusive of maintenance<br \/>\nallowance, if any, available to the workmen, with effect<br \/>\nfrom 31st December, 1998 till 30th April, 2003 within<br \/>\nperiod of three months from the date of receiving the<br \/>\ncopy of the affidavit as required u\/s 17-B of the I.D.Act<br \/>\nfrom each workman concerned individually along with copy<br \/>\nof this order.    On the other hand, learned advocate<br \/>\nMs.Sona Sagar undertakes that all 79 workmen concerned<br \/>\nwho are out of job and not employed in any establishment<br \/>\nand   not    receiving   adequate remuneration from the<br \/>\nemployer, will file necessary affidavit under Section<br \/>\n17-B of the Act immediately within period of four weeks<br \/>\nfrom the date of receiving the copy of this order without<br \/>\nany delay.
