Justice V.GIRI\n\n Dated :28\/05\/2009\n\n O R D E R\n                             V.GIRI,J.\n                      -------------------------\n                  W.P ( C) No.14604 of 2009\n                      --------------------------\n                Dated this the 28th May,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      The petitioner is aggrieved by what is claimed as<\/p>\n<p>illegal seizure and     detention of Lorry by the         1st<\/p>\n<p>respondent on 13.5.2009. Going by Exhibit-P2 Seizure<\/p>\n<p>Mahazar, lorry has been seized for the infraction of the<\/p>\n<p>provisions of Kerala Protection of River Banks           and<\/p>\n<p>Regulation of Removal of Sand Act, 2002. It is open to the<\/p>\n<p>petitioner to approach the District Collector , invoking his<\/p>\n<p>powers under Rules 27 and 28 of the Kerala Protection of<\/p>\n<p>River Banks and Regulation of Removal Sand Rules for<\/p>\n<p>release of the vehicle.\n<\/p>\n<p>      2.   If such an application is filed by the petitioner,<\/p>\n<p>the District Collector     shall cause an enquiry to be<\/p>\n<p>conducted and pass orders as early as possible. If the<\/p>\n<p>District Collector feels that         the enquiry into the<\/p>\n<p>application will take time then the District Collector shall<\/p>\n<p>consider the application for release of the vehicle on<\/p>\n<p>W.P ( C) No.14604 of 2009<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>interim custody. This shall be done keeping in mind the<\/p>\n<p>observations of this Court in Subramanian Vs. State of<\/p>\n<p>Kerala     [ 2009(1) KLT 77]        as also the observations<\/p>\n<p>contained in Shoukathali Vs.
