Justice T.R.RAMACHANDRAN NAIR\n\n Dated :30\/11\/2009\n\n O R D E R\n                T.R RAMACHANDRAN NAIR,J.\n                      -------------------------\n                  W.P ( C) No.33479 of 2009\n                      --------------------------\n            Dated this the 30th November,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      Petitioners herein are     working as Lower Primary<\/p>\n<p>School Assistants under the 5th respondent Manager. They<\/p>\n<p>were appointed as per Exts.P1 and P2 orders in permanent<\/p>\n<p>vacancies.\n<\/p>\n<p>      2.   By Exts.P3 and P4, their appointments have<\/p>\n<p>been approved only on daily wage basis for the periods<\/p>\n<p>shown in the said orders.\n<\/p>\n<p>      3.   This is challenged by the petitioners in this writ<\/p>\n<p>petition. It is pointed out that the approvals have been<\/p>\n<p>restricted by relying on     Ext.P5 order. Ext.P5 order is<\/p>\n<p>dated 10.6.2008.\n<\/p>\n<p>      4.   Learned counsel for the petitioner submitted<\/p>\n<p>that in the light of the decision of the Division Bench of<\/p>\n<p>this Court, produced as Ext.P6, the orders of approval as<\/p>\n<p>passed now cannot be sustained. Therein, this Court has<\/p>\n<p>held that Ext.P5 Government Order cannot be enforced<\/p>\n<p>without amendment of the statutory rules.<\/p>\n<p>W.P ( C) No.33479 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>      5.      It is therefore clear that the orders of approval<\/p>\n<p>granted      cannot be justified. The principles laid down in<\/p>\n<p>Ext.P6, applies herein.\n<\/p>\n<p>       6.    Learned Government Pleader, on instructions,<\/p>\n<p>submitted that        the Manager has already filed separate<\/p>\n<p>appeals before the 3rd respondent in the matter which are<\/p>\n<p>pending.
