Justice P.S.GOPINATHAN\n\n Dated :10\/02\/2010\n\n O R D E R\n    C.N.Ramachandran Nair &amp; P.S.Gopinathan, JJ.\n   ============================================\n                I.T.A.1792 of 2009\n   ============================================\n     Dated this the 10th day of February, 2010.\n\n\n                     JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<\/p>\n<p>1.This appeal is filed against the orders of the<\/p>\n<p> Tribunal   confirming   the   assessment  on   the<\/p>\n<p> appellant for the assessment years 1998-99.     We<\/p>\n<p> heard  the   senior  counsel   appearing  for  the<\/p>\n<p> appellant assessee and standing counsel for the<\/p>\n<p> respondent.\n<\/p>\n<\/p>\n<p>2.Even  though  senior   counsel  raised  objection<\/p>\n<p> against  the  status   adopted  as  Assocation  of<\/p>\n<p> Persons for assessment, we do not find any merit<\/p>\n<p> because, the appellant, along with five others,<\/p>\n<p> was the licensee.   The members of the appellant<\/p>\n<p> AOP were the licensees, who are entitled to carry<\/p>\n<p> on business in the toddy shop.    It is seen that<\/p>\n<p><span class=\"hidden_text\">ITA 1792\/09               -:2:-<\/span><\/p>\n<p>the business was in fact carried on by all the<\/p>\n<p>members.     In our view, since the members of the<\/p>\n<p>AOP carried on business, pursuant to the licence<\/p>\n<p>obtained by them for the 52 toddy shops in<\/p>\n<p>Thalassery, the assessment in their names as AOP<\/p>\n<p>is perfectly justified.        The next contention,<\/p>\n<p>namely,    assessment  of   income  in  toddy  shops<\/p>\n<p>confirmed by the Tribunal also does not call for<\/p>\n<p>any interference, because, admittedly, assessee<\/p>\n<p>did not keep any books of accounts.        The last<\/p>\n<p>ground     is  with  regard    to  the  addition of<\/p>\n<p>Rs.4,57,520\/- under Section 68 for the reason<\/p>\n<p>that the three creditors in whose name amount was<\/p>\n<p>credited     did  not  prove    the  transaction  as<\/p>\n<p>genuine.     The senior counsel appearing for the<\/p>\n<p>appellant rightly pointed out that when accounts<\/p>\n<p>were rejected and business income estimated, such<\/p>\n<p>income itself would account for the unexplained<\/p>\n<p>cash, which was shown as the         source for the<\/p>\n<p><span class=\"hidden_text\">ITA 1792\/09             -:3:-<\/span><\/p>\n<p>payment of kist amount.     Since assessee did not<\/p>\n<p>maintain any books of accounts, obviously he was<\/p>\n<p>generating   black money   and  that  is  what  is<\/p>\n<p>assessed through estimation.    The funds shown as<\/p>\n<p>credit in the name of bogus persons obviously<\/p>\n<p>were the assessee&#8217;s own funds and so much so, we<\/p>\n<p>do not find any justification for any addition<\/p>\n<p>over the estimated income.    We, therefore, allow<\/p>\n<p>the appeal in part by reversing the order of the<\/p>\n<p>Tribunal and that of the lower authorities by<\/p>\n<p>deleting the addition of Rs.4,57,520\/- made under<\/p>\n<p>Section 68 of the Act.  The order of the Tribunal<\/p>\n<p>confirming the addition under Section 68 would<\/p>\n<p>stand cancelled.   Even though counsel for the<\/p>\n<p>assessee pointed out that huge amount of interest<\/p>\n<p>is levied on the assessee under Section 234, we<\/p>\n<p>feel that, recourse open to the assessee is to<\/p>\n<p>make application before the Chief Commissioner<\/p>\n<p>for waiver in the light of the circular issued by<\/p>\n<p><span class=\"hidden_text\"> ITA 1792\/09             -:4:-<\/span><\/p>\n<p> the Board of Revenue.
