It was submitted that<br \/>\nconsidering the peculiar circumstances as the election of the<br \/>\nassembly was to be held and code of conduct was operating, the<br \/>\nMunicipality had to exercise power in urgent circumstances and<br \/>\ntherefore, it has been submitted that the Collector ought not to have<br \/>\nset aside the decision and Director of Municipality ought not to have<br \/>\nconfirmed the order of the Collector. It has been submitted that<br \/>\ntherefore, this Court may interfere.\n<\/p>\n<p>4.\tHaving<br \/>\nconsidered the above, it deserves to be recorded that as per the<br \/>\nprovisions of Section 65 of the Act, if the Municipality has to enter<br \/>\ninto in lease or sale or otherwise transfer of the immovable property<br \/>\nfor a period exceeding one year, prior approval of the District<br \/>\nCollector is required to be obtained. Therefore, if a period exceeds<br \/>\none year, the provision of Section 65 of the Act would be attracted.<br \/>\nIn the present case, initially the period of the lease was fixed at<br \/>\n11 months and 29 days, so as to see that no permission may be<br \/>\nrequired and such lease in any case, was<br \/>\nwithin power of Municipality. It deserves to be recorded that<br \/>\nthe earlier decision of the grant of lease by general body of the<br \/>\nMunicipality and therefore, if the period was to be extended, the<br \/>\nPresident may not as such take the decision for extension of period<br \/>\nand even if general body was to take decision, it may consequently<br \/>\nresult into attracting the provision of Section 65 of the Act for<br \/>\nprior approval from the District Collector. It is an admitted<br \/>\nposition that no permission of the District Collector was obtained.<br \/>\nTherefore, District Collector exercised the power under Section 258<br \/>\nof the Act.\n<\/p>\n<p>5.\tThe<br \/>\ncontention that the matter would fall outside the scope and ambit of<br \/>\nSection 258 of the Act, cannot be accepted for the simple reason that<br \/>\nthe language of Section 258(1) of the Act refers to the exercise of<br \/>\npower by the Collector, if anything is done by the Municipality is<br \/>\nunlawful. The provision of the Act are widely read for supervisory<br \/>\njurisdiction of the Collector. It has been interpreted to the extent<br \/>\nthat if in case service matter pertaining to the employee, whether<br \/>\nthe action is taken and is already implemented, the Corporation has<br \/>\npower under Section 258 of the Act. The reference may be made to the<br \/>\ndecision of this Court in the case of Harendra Pandya Vs.<br \/>\nBharuch Municipality reported in 1989 (1) GLH 470.<br \/>\nNot only, but as per the decision of Full Bench of this Court in<br \/>\nthe case of  Parshottambhai G. Chavda Vs. State of Gujarat<br \/>\nreported in 1998 (1) GLH 519, the<br \/>\nCollector has power to direct status-quo ante<br \/>\nunder Section 258 of the Act by maintaining position as it<br \/>\nexercised prior to the Resolution of the Municipality.<br \/>\nTherefore, on the basis of the aforesaid judgment of the<br \/>\nDivision Bench as well as of the full Bench of this Court, the<br \/>\ncontention cannot be accepted and deserves to be rejected.\n<\/p>\n<p>6.\tAn<br \/>\nattempt on the part of the learned counsel for the petitioner to<br \/>\ncontend that there was peculiar circumstances because of code of<br \/>\nconduct, also cannot be countenanced for the simple reason that<br \/>\nmerely because election was being held of the assembly, there is no<br \/>\nblanket prohibition against<br \/>\ntaking any decision. The only requirement would be, the prior<br \/>\napproval of the Election Commission. Nothing prevented from the<br \/>\nMunicipality from taking approval\/permission of Election Commission,<br \/>\nhad the contention been genuine.\n<\/p>\n<p>7.\tThe<br \/>\nCollector has found that the decisions of the President of<br \/>\nMunicipality as well as general body of the Municipality are not in<br \/>\naccordance with the requirement of the Act and Director of the<br \/>\nMunicipality has concurrent with the same. It cannot be said that any<br \/>\nillegality is committed, which may call for interference by this<br \/>\nCourt in a petition under Article 226 and 227 of the Constitution.\n<\/p>\n<p>8.\tHence,<br \/>\nno case is made out.
