DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/02\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tRule.\n<\/p>\n<p> Learned APP, waives service of rule in each of the petitions for the<br \/>\nrespondent-State.\n<\/p>\n<p>2.\tThese<br \/>\npetitions under Section 482 of the Criminal Procedure Code, 1973 are<br \/>\nfiled with following prayers:\n<\/p>\n<p>&#8220;(a)<br \/>\nYour Lordships be pleased to admit this petition;\n<\/p>\n<p>(b)<br \/>\nYour Lordships be pleased to allow this petition by way of quashing<br \/>\nand setting aside the complaint being CR No.I-447 of 2010 filed<br \/>\nbefore Malaviya Nagar Police Station, Rajkot at Annexure-A;\n<\/p>\n<p>(c)<br \/>\nDuring the pendency and final disposal of this petition, Your<br \/>\nLordships may be pleased to stay the further investigation and all<br \/>\nsubsequent proceedings in pursuance of the complaint being CR<br \/>\nNo.I-447 of 2010 filed before Malaviya Nagar Police Station, Rajkot<br \/>\nat Annexure-A;\n<\/p>\n<p>(d)<br \/>\nTo pass any other appropriate and just order\/s;&#8221;\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate for the petitioners submit that petitioners are students and<br \/>\ndue to misunderstanding the complaints have been filed and due to<br \/>\nintervention of elderly persons and having realized consequences of<br \/>\nthe action taken both the parties have decided to bury the hatchet<br \/>\nand arrive at a amicable settlement.  All the persons are  young and<br \/>\nat the threshold of their carrier.  That, complainants have filed<br \/>\naffidavits and have reiterated the contents of the affidavits that<br \/>\nthey have no objection if the impugned complaint are quashed and set<br \/>\naside.  The complainants are present in the Court.\n<\/p>\n<p>4.\tConsidering<br \/>\nthe nature of offence, the scuffle took place out of range and that<br \/>\nthey are students, I deem it just and proper to exercise powers under<br \/>\nSection 482 of the Code by quashing and setting aside the impugned<br \/>\ncomplaint and accordingly the complaint is quashed and set aside.<br \/>\nThese petitions are allowed.
