No.<br \/>\nI-59\/2010, has been registered with Lodhika Police Station.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocate Mr. Raiyani referred to the papers and the allegations in<br \/>\nthe FIR and submitted that sec. 306 would not be attracted. He<br \/>\nsubmitted that the allegations are of a general nature and therefore<br \/>\nthe present application may be allowed.\n<\/p>\n<p>4.\tLearned<br \/>\nAPP Ms. Shah resisted the application.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocate Mr. Raiyani and learned APP Ms. Shah and<br \/>\nhaving considered the nature of offence, the manner in which it is<br \/>\nalleged to have been committed, the role attributed, the present<br \/>\napplication deserves to be allowed.\n<\/p>\n<p>6.\tThe<br \/>\napplication is accordingly allowed.  The applicant is ordered to be<br \/>\nreleased on bail in connection with C.R. No. I-59\/2010,<br \/>\nregistered with Lodhika Police Station, on his<br \/>\nexecuting a personal bond of Rs. 5,000\/- (Rupees Five Thousand only)<br \/>\nwith one solvent surety for the like amount to the satisfaction of<br \/>\nthe lower court and subject to the further conditions that he shall :\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to<br \/>\ntry to tamper or pressurize the prosecution witnesses or complainant<br \/>\nin any manner;\n<\/p>\n<p>(c )\tnot<br \/>\nact in any manner injurious to the interests of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should co-operate with the investigating officers;\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before the concerned Police Station on the first Monday<br \/>\nof every calendar month between 11.00 am to 2.00 pm till the charge<br \/>\nsheet is filed.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the investigating officer and also to<br \/>\nthe court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the court.\n<\/p>\n<p>(g)\tsurrender<br \/>\nhis passport, if any, to the lower court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower court having jurisdiction to try the case. It would<br \/>\nbe open to the trial court concerned to give time to furnish the<br \/>\nsolvency certificate, if prayed for.\n<\/p>\n<p>\tRule is<br \/>\nmade absolute.
