Justice K.T.SANKARAN\n\n Dated :25\/03\/2010\n\n O R D E R\n                       K.T.SANKARAN, J.\n                 ---------------------------------------------\n                      B.A.No.1177 of 2010\n                 ---------------------------------------------\n             Dated this the 25th day of March, 2010\n\n\n                              O R D E R\n<\/pre>\n<p>     This is an application for anticipatory bail under Section<\/p>\n<p>438 of the Code of Criminal Procedure. The petitioners are<\/p>\n<p>accused Nos.1, 2 and 3 in Crime No.1408 of 2009 of Kundara<\/p>\n<p>Police Station, Kollam District.\n<\/p>\n<p>     2.    The petitioners apprehend arrest on the basis that the<\/p>\n<p>offences alleged against them are under Sections 143, 147, 148,<\/p>\n<p>324 and 326 read with Section 149 of the Indian Penal Code.<\/p>\n<p>     3.    The learned Public Prosecutor submitted that during<\/p>\n<p>investigation, it was revealed that the first accused is not<\/p>\n<p>involved in the offence. It was also revealed that the offence<\/p>\n<p>under Section 326 IPC is not made out. It is submitted that as of<\/p>\n<p>now, the offences alleged against the accused are bailable<\/p>\n<p>offences under Sections 323 and 325 read with Section 34 of the<\/p>\n<p>Indian Penal Code.
