Mr.    Satish    Chandra      Jha     No.3,        learned<\/p>\n<p>                   counsel for the petitioner, Mr. Nagendra Sharma,<\/p>\n<p>                   learned Assisting Counsel to G.P.8 for the State<\/p>\n<p>                   and learned counsel for the Accountant General,<\/p>\n<p>                   Bihar are present.\n<\/p>\n<p>                                By the order passed in the writ petition,<\/p>\n<p>                   the    order       dated   26.4.2005      was    quashed    and       the<\/p>\n<p>                   Principal      Secretary,         Water   Resources      Department,<\/p>\n<p>                   Govt. of Bihar, Patna was required to reconsider<\/p>\n<p>                   the matter and pass a fresh order after providing<\/p>\n<p>                   due opportunity to the petitioner of presenting<\/p>\n<p>                   his case in relation to his claims for Ist and 2nd<\/p>\n<p>                   ACP    and     salary       for     the   period      1.8.1990        to<\/p>\n<p>                   24.6.1996.\n<\/p>\n<p>                                The matter was considered on 6.10.2010 and<\/p>\n<p>                   the compliance was found wanting inasmuch as the<\/p>\n<p>                   order passed by the Principal Secretary contained<\/p>\n<p>                   in    Memo    no.3986      dated    20.7.2010     said     to    be   in<\/p>\n<p>                   purported compliance of the order passed by this<\/p>\n<p>                   Court in C.W.J.C.No.3413 of 2007 was in fact in<\/p>\n<p>                   the teeth of the said order. As such, the order is<\/p>\n<p>                   ignored.\n<\/p>\n<p><span class=\"hidden_text\">                     2<\/span><\/p>\n<p>               As a consequence thereof, the direction of<\/p>\n<p>      this Court yet remains to be complied.<\/p>\n<p>                Today,        learned      counsel    representing         the<\/p>\n<p>      State and other authorities, on instructions from<\/p>\n<p>      the     Principal            Secretary,        Water       Resources<\/p>\n<p>      Department, prays for three weeks time to ensure<\/p>\n<p>      compliance        of   the    directions       contained       in    the<\/p>\n<p>      order dated 9.12.2009 passed in C.W.J.C.No.3413 of<\/p>\n<p>      2007.\n<\/p>\n<p>               Although        under    the   directions        aforesaid,<\/p>\n<p>      the order was to be complied by March, 2010 and<\/p>\n<p>      the   delay   is       unexplained      but    by   way    of       extra<\/p>\n<p>      ordinary indulgence, the matter is being adjourned<\/p>\n<p>      until   Ist   December        2010    enabling      the    Principal<\/p>\n<p>      Secretary,    Water      Resources      Department        to    ensure<\/p>\n<p>      compliance        of   the    directions       contained       in     the<\/p>\n<p>      order dated 9.12.2009 passed in C.W.J.C.No.3413 of<\/p>\n<p>      2007, failing which the Principal Secretary shall,<\/p>\n<p>      at the first instance, be liable for depositing a<\/p>\n<p>      cost quantified at Rs.5000\/- from his pocket with<\/p>\n<p>      the Bihar State Legal Services Authority.<\/p>\n<p>               Put up on 1.12.2010 in Chambers at 4.15<\/p>\n<p>      P.M., if not sitting singly.\n<\/p>\n<\/p>\n<pre>ahk                            (Jyoti Saran, J)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ram Sakal Singh vs The State Of Bihar &amp;Amp; Ors. on 10 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA MJC No.3840 of 2010 RAM SAKAL SINGH Versus THE STATE OF BIHAR &amp; ORS. &#8212;&#8212;&#8212;&#8211; 3. 10.11.2010.
