Opposite parties\n\n                             ---------\n\nHon'ble Rajiv Sharma, J.\n<\/pre>\n<p>      Heard Mr. Prem Shanker, learned Counsel for the petitioner<br \/>\nand Mr. Anil Saran, learned Standing Counsel.\n<\/p>\n<p>      Undisputed facts of the case are that initially, the petitioner<br \/>\nwas appointed on the post of Mate in the year 1984 and<br \/>\nsubsequently, the petitioner was regularized on the post of Beldar<br \/>\non 19.9.2000. While working on the said post, one Satya Pal has<br \/>\nfiled a Civil Misc. Writ Petition No. 18224 of 2006 at the Principal<br \/>\nSeat in which the petitioner of the instant writ petition has also<br \/>\nbeen impleaded. This Court at Allahabad disposed of the aforesaid<br \/>\nwrit petition finally vide order dated 3.12.2007. The operative<br \/>\nportion of the said order is as under:-\n<\/p>\n<blockquote><p>             &#8220;&#8230; In view of above, the writ petition is<br \/>\n      disposed of with the direction that the petitioner shall<br \/>\n      submit fresh representation to the opposite party No.4<br \/>\n      within a period of one month from th date of receipt of<br \/>\n      a certified copy of this order and in case, such<br \/>\n      representation is made, the Executive Engineer shall<br \/>\n      consider and decide the representation of the<br \/>\n      petitioner in accordance with law keeping in view the<br \/>\n      observations made hereinabove by passing a<br \/>\n      reasoned      and    speaking      order   expeditiously,<br \/>\n      preferably, within a period of three months from the<br \/>\n      date of receipt of a certified copy of this order. While<br \/>\n      deciding the case of the petitioner, it shall also be<br \/>\n      incumbent to the Executive Engineer to provide<br \/>\n      opportunity to the opposite party No.5 for compliance<br \/>\n      of principles of natural justice keeping in view the long<br \/>\n      tenure of the petitioner&#8217;s service on the post of Beldar<br \/>\n      to grant promotion on the post of Meth from the date<br \/>\n      juniors were promoted.&#8221;<\/p><\/blockquote>\n<p>      A perusal of the impugned order, it reflects that no<br \/>\nopportunity of hearing has been afforded either to the petitioner<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>or to Mr. Satya Pal\/opposite party No.6 and the said order has<br \/>\nbeen passed only on the basis of the records available with the<br \/>\nopposite parties and as such, the authority concerned, while<br \/>\ndeciding the representation has not acted in the letter and spirit of<br \/>\nthe judgment passed in Civil Misc. Writ Petition No. 18224 of<br \/>\n2006, the impugned order is liable to be quashed.\n<\/p>\n<p>      Accordingly, the writ petition is allowed and the impugned<br \/>\norder dated 18.2.2008 is hereby quashed. The opposite parties<br \/>\nare directed to consider the representation of Satya Pal, strictly in<br \/>\nlight of the judgment and order dated 3.12.2007 passed in Civil<br \/>\nMisc. Writ Petition No. 18224 of 2006. It is made clear that notice<br \/>\nin writing be issued by the opposite parties to the petitioner and<br \/>\nSatya Pal, before taking decision on the representation moved by<br \/>\nSatya Pal\/opposite party No.6.
