Advocate\n\nHon'ble Sheo Kumar Singh,J.\n<\/pre>\n<p>Hon&#8217;ble Shyam Shankar Tiwari,J.\n<\/p>\n<p>Heard Sri Narendra Kumar Singh, learned Advocate who<br \/>\nappeared to press the bail application of Salim who is<br \/>\nconvicted for an offence punishable under Section so<br \/>\nmentioned in the judgment and he is to serve out the<br \/>\nsentence so provided and learned A.G.A.\n<\/p>\n<p>Submission is that although in the F.I.R. version was given<br \/>\nthat Salim and other co-accused Azim fired on the deceased<br \/>\nbut in the evidence it has come that fire of Azim hit the<br \/>\ndeceased.\n<\/p>\n<p>Submission is that it is a case of single shot which was<br \/>\nreceived by the deceased and thus in view of the clear<br \/>\nstand\/version given in the evidence the main shooter can be<br \/>\nsaid to be Azim and thus appellant is entitled to be released<br \/>\non bail as he did not misuse the liberty which was allowed to<br \/>\nhim during trial for so long. Besides the aforesaid<br \/>\nsubmission is that distance of fire and other things as has<br \/>\nbeen noted in the judgment can be taken note.\n<\/p>\n<p>Learned Government side submits that although it has come<br \/>\nin the evidence that fire of Azim hit the deceased but as the<br \/>\nappellant was also there with the fire arm and he fired, the<br \/>\nintention was clear and thus after conviction he is not<br \/>\nentitled for bail.\n<\/p>\n<p>After hearing argument and on notice of the findings so<br \/>\ngiven, this is clear that learned trial judge gave a clear<br \/>\nfinding\/observation based on the submission\/evidence that<br \/>\nfire of Azim hit the deceased. This is a case where single<br \/>\nshot was received and thus in view of the specific identity in<br \/>\nrespect to the factum of fire, the appellant whose case is<br \/>\nfound to be distinguishable with Azim, is to be enlarged on<br \/>\nbail, keeping in mind the fact that for about six years he was<br \/>\non bail and he did not misuse the liberty.<br \/>\n Let the appellant Saleem son of Nanhey Khan be enlarged<br \/>\non bail in S.T. No. 102 of 2003 (State Vs. Azim and another)<br \/>\non his furnishing a personal bond and two sureties each in<br \/>\nthe like amount to the satisfaction of the court concerned.<br \/>\nRealisation of fine to the extent of 50% shall remain stayed.<br \/>\nBalance amount of fine shall be deposited forthwith.
