SANKARAN,J.\n\n                             --------------------------------------\n                            W.P.(C) No.24135 of 2008 W\n                             --------------------------------------\n                      Dated this the 11th day of August, 2008.\n\n                                    J U D G M E N T\n<\/pre>\n<p>              The petitioner is working as Lower Grade Sanskrit Teacher (Part<\/p>\n<p>Time) in the     fifth respondent&#8217;s school.         According to the petitioner, he was<\/p>\n<p>appointed as Part Time Lower Grade Sanskrit Teacher with effect from 4.6.2007<\/p>\n<p>onwards against the retirement vacancy of Smt. B.Suseela.                 The Manager<\/p>\n<p>forwarded the proposal for appointment to the Assistant Educational Officer for<\/p>\n<p>approval. The Assistant Educational Officer rejected the appointment of the<\/p>\n<p>petitioner for the reason that the school is a newly opened one and the vacancy<\/p>\n<p>was to be filled up by appointing a protected teacher. On appeal, the District<\/p>\n<p>Educational Officer rejected the appeal confirming the order passed by the<\/p>\n<p>Assistant Educational Officer. The Manager preferred a revision to the Director<\/p>\n<p>of Public Instruction who disposed of the revision as per Ext.P2 order dated<\/p>\n<p>26.5.2008. The Director of Public Instruction held in Ext.P2 as follows:-<\/p>\n<blockquote><p>                                          &#8220;The revision petition has<\/p>\n<p>                      been examined in detail in consultation with<\/p>\n<p>                      the Assistant Educational Officer and the<\/p>\n<p>                      rules now in force. As per GO(P)46\/06\/GEdn.<\/p>\n<p>                      Dt.1.2.2006 the appeal can be allowed on<\/p>\n<p>                      daily wages since there is no protected<\/p>\n<p>                      teacher for deployment as reported by the<\/p>\n<p>                      Deputy Director of Education, Kollam.<\/p>\n<\/blockquote>\n<p>WP(C) No.24135\/2008<\/p>\n<p><span class=\"hidden_text\">                                           2<\/span><\/p>\n<p>                                       In the circumstances the<\/p>\n<p>                    revision petition preferred by the manager is<\/p>\n<p>                    allowed     and    the   Assistant   Educational<\/p>\n<p>                    Officer, Karunagappally is directed to approve<\/p>\n<p>                    the appointment of       Sri.Binu.C.S. as Junior<\/p>\n<p>                    Sanskrit Teacher with effect from 4.6.2007<\/p>\n<p>                    onwards on daily wages, if it is otherwise in<\/p>\n<p>                    order.&#8221;\n<\/p>\n<\/p>\n<p>                  2.         The contention of the petitioner is that the reason<\/p>\n<p>stated in Ext.P2 order for rejecting the approval is not sustainable as per the<\/p>\n<p>existing rules. It is stated that there was no existing protected Lower Grade<\/p>\n<p>Sanskrit Teacher (Part Time) and, therefore, there was no impediment in<\/p>\n<p>approving the appointment of the petitioner.         Challenging Ext.P2 order the<\/p>\n<p>petitioner has filed a statutory revision petition dated 21.7.2008 (Ext.P4) before<\/p>\n<p>the first respondent. Ext.P4 is pending disposal.<\/p>\n<p>                     3.      The reliefs prayed for in the Writ Petition are the<\/p>\n<p>following:-\n<\/p>\n<\/p>\n<p>                                       &#8220;I.      Call for the records<\/p>\n<p>                     leading to Ext.P2 and quash the same by<\/p>\n<p>                     issuing a writ of certiorari<\/p>\n<p>                                       II.          Issue a writ, of<\/p>\n<p>                     mandamus or other writ order or direction to<\/p>\n<p>                     the 1st respondent to consider and pass orders<\/p>\n<p>WP(C) No.24135\/2008<\/p>\n<p><span class=\"hidden_text\">                                            3<\/span><\/p>\n<p>                     on Ext.P4 revision petition after hearing the<\/p>\n<p>                     petitioner and pass necessary orders granting<\/p>\n<p>                     approval of the appointment made by the 5th<\/p>\n<p>                     respondent.\n<\/p>\n<\/p>\n<p>                                        III.   Issue a writ, order or<\/p>\n<p>                     direction to the 1st respondent to declare the<\/p>\n<p>                     petitioner&#8217;s    appointment     is    a   regular<\/p>\n<p>                     appointment.\n<\/p>\n<\/p>\n<p>                                        iv.  to grant such other and<\/p>\n<p>                     further relief which this Hon&#8217;ble Court just and<\/p>\n<p>                     for in the circumstances of the case.&#8221;\n<\/p>\n<\/p>\n<p>                  4.         In view of the pendency of Ext.P4 revision, the only<\/p>\n<p>relief to which the petitioner is entitled to, for the present, is to direct the first<\/p>\n<p>respondent to dispose of Ext.P4 revision.<\/p>\n<p>                  5.         In the manner in which I propose to dispose of the<\/p>\n<p>Writ Petition, I do not think it is necessary to issue notice to the fifth respondent.<\/p>\n<p>Learned Government Pleader took notice for respondents 1 to 4.<\/p>\n<p>                     In the facts and circumstances of the case, the Writ Petition<\/p>\n<p>is disposed of as follows:-\n<\/p>\n<p>WP(C) No.24135\/2008<\/p>\n<p><span class=\"hidden_text\">                                         4<\/span><\/p>\n<p>                  (1)      The first respondent shall consider and dispose of<\/p>\n<p>Ext.P4 revision dated 21.7.2008 filed by the petitioner, as expeditiously as<\/p>\n<p>possible and at any rate within a period of three months, after affording an<\/p>\n<p>opportunity of being heard to the petitioner and the Manager.<\/p>\n<p>                  (2)      The petitioner shall produce certified copy of the<\/p>\n<p>judgment and a copy of the Writ Petition before the first respondent. It is made<\/p>\n<p>clear that the petitioner is entitled to produce such other materials and<\/p>\n<p>documents before the first respondent in support of his contentions.<\/p>\n<p>                  (3)      The petitioner shall send a copy of the judgment to<\/p>\n<p>the fifth respondent by registered post and shall produce proof of the same<\/p>\n<p>before the first respondent.\n<\/p>\n<\/p>\n<p>                                                      K.T.
