BASANT, J.\n\n              -------------------------------------------------\n\n                       W.P.(C) NO. 4943 2007-L\n\n              -------------------------------------------------\n\n           Dated this the 26th day of February, 2007\n\n\n                              JUDGMENT\n<\/pre>\n<p>      The petitioner is aggrieved by Ext.P2 order passed under<\/p>\n<p>Sec.451 of the Cr.P.C. by the learned Magistrate   refusing to<\/p>\n<p>return the vehicle belonging to him and seized by the police in<\/p>\n<p>connection with an offence punishable under the provisions of<\/p>\n<p>the Kerala Abkari Act.\n<\/p>\n<\/p>\n<p>      2.   The     learned   Public   Prosecutor,   after   taking<\/p>\n<p>instructions,   submits   that   proceedings   under   Sec.67B   of   the<\/p>\n<p>Abkari Act were initiated against the  petitioner and  by order<\/p>\n<p>dated   27\/9\/06   passed   by   the   Assistant   Excise   Commissioner,<\/p>\n<p>Kozhikode,   the   vehicle     has   been   ordered   to   be   confiscated.<\/p>\n<p>Against that, the petitioner, through his counsel, has preferred<\/p>\n<p>an   appeal   and   the   Additional   Excise   Commissioner,<\/p>\n<p>Trivandrum,   by   order   dated   23\/2\/07   has   already   disposed   of<\/p>\n<p>that   appeal   dismissing   the   same.           In   these   circumstances,<\/p>\n<p>there is no merit or grace in the prayer made by the learned<\/p>\n<p>counsel for the petitioner in this writ petition that the vehicle<\/p>\n<p>may   be   released   to   the   petitioner.       The   petitioner   is<\/p>\n<p><span class=\"hidden_text\"> W.P.(C) NO. 4943 2007-L                  -: 2 :-<\/span><\/p>\n<p>contumaciously     guilty   of   suppressing   the   order   of   confiscation<\/p>\n<p>under   Sec.67B   of   the   Abkari   Act   and   the   further   proceedings<\/p>\n<p>taken in pursuance of that order, points out the  learned Public<\/p>\n<p>Prosecutor.\n<\/p>\n<\/p>\n<p>        3.     I   am   satisfied   that   an   order   of   confiscation   having<\/p>\n<p>already been passed, the petitioner cannot be heard to complain<\/p>\n<p>about the dismissal of the petition filed by him under Sec.451 of<\/p>\n<p>the Cr.P.C.\n<\/p>\n<\/p>\n<p>        4.       In   the   result,   this   writ   petition   is   dismissed.     I   may<\/p>\n<p>hasten   to   observe   that   the   petitioner&#8217;s   right   to   challenge   the<\/p>\n<p>order   passed   under   Sec.67B   of   the   Abkari   Act   and   the   further<\/p>\n<p>orders   thereon   shall   remain   unfettered   by   the   dismissal   of   this<\/p>\n<p>writ petition.\n<\/p>\n<\/p>\n<p>                                                                      Sd\/-\n<\/p>\n<p>\n                                                          (R.
