Justice THOMAS P.JOSEPH\n\n Dated :15\/09\/2010\n\n O R D E R\n                   THOMAS P.JOSEPH, J.\n           ====================================\n                     Tr.P(C) No.346 of 2009\n           ====================================\n         Dated this the 15th   day of September,  2010\n\n\n                           O R D E R\n<\/pre>\n<p>      Respondent is served on the petition but he has not<\/p>\n<p>responded.\n<\/p>\n<\/p>\n<p>      2.   This petition is filed by wife and children seeking<\/p>\n<p>transfer of O.P. No.193 of 2009 from Family Court, Kasargod to<\/p>\n<p>Family Court, Ernakulam. It is stated that petitioner No.1 and her<\/p>\n<p>minor children are staying with the aged parents of petitioner No.1<\/p>\n<p>at Paravur Village, Ernakulam District, far away from Kasargod.<\/p>\n<p>She has filed M.C.No.195 of 2009 seeking maintenance from the<\/p>\n<p>respondent and O.P. No.1024 of 2009 for return of money and for<\/p>\n<p>other reliefs, also against the respondent in Family Court,<\/p>\n<p>Ernakulam and those cases are pending. Petitioners request     that<\/p>\n<p>the case pending in Family Court, Kasargod may be transferred to<\/p>\n<p>Family Court,Ernakulam.\n<\/p>\n<p>      3.   The    Supreme Court in Sumitha Singh v. Kumar<\/p>\n<p>Sanjay and another (AIR 2002 SC 396) and <a href=\"\/doc\/1640831\/\">Arti Rani v.<\/p>\n<p>Dharmendra Kumar Gupta<\/a> ([2008] 9 SCC 353) has stated that<\/p>\n<p>Tr.P(c) No.346 of 2009<br \/>\n<span class=\"hidden_text\">                                   -: 2 :-<\/span><\/p>\n<p>while considering request for transfer of matrimonial proceedings<\/p>\n<p>convenience of the wife has to be looked into.         That of course<\/p>\n<p>does not mean that       inconvenience of the husband has to be<\/p>\n<p>ignored.    It is seen that two cases filed by petitioner No.1 are<\/p>\n<p>pending in Family Court, Ernakulam. Respondent has to come to<\/p>\n<p>Ernakulam to contest those cases. Till now there is no request<\/p>\n<p>for transfer of those cases made by the respondent. Petitioners<\/p>\n<p>are residing in      Paravur which is far away from Kasargod.<\/p>\n<p>Petitioner No.1, the wife has to travel a very long distance to<\/p>\n<p>Kasargod. She is aged 29 years.             She may have to be<\/p>\n<p>accompanied by some relative which involves huge expenses.<\/p>\n<p>She has also to look after her minor children. The hardship that<\/p>\n<p>petitioner No.1 has to suffer        if the request is not allowed<\/p>\n<p>outweighs the hardship that may be caused to the respondent if<\/p>\n<p>transfer of the case is allowed. Hence I am inclined to allow this<\/p>\n<p>petition.\n<\/p>\n<p>      Resultantly, this petition is allowed in the following lines:<\/p>\n<p>             (i)    O.P. No.193 of 2009 pending in Family<\/p>\n<p>      Court, Kasargod is withdrawn from that court and<\/p>\n<p>      made over to Family Court, Ernakulam.\n<\/p>\n<p>Tr.P(c) No.346 of 2009<br \/>\n<span class=\"hidden_text\">                                  -: 3 :-<\/span><\/p>\n<p>             (ii)   The transferor court while transmitting<\/p>\n<p>      records of the case to the transferee court shall fix<\/p>\n<p>      date for appearance of       parties in the transferee<\/p>\n<p>      court with due     intimation to the counsel for both<\/p>\n<p>      parties.\n<\/p>\n<\/p>\n<p>             (iii)  The transferee court shall ensure that all<\/p>\n<p>      the cases are posted on the same dates, as far as<\/p>\n<p>      possible.\n<\/p>\n<\/p>\n<p>             (iv)   It is made clear that except when<\/p>\n<p>      physical presence of the respondent in court is<\/p>\n<p>      necessary he can appear through counsel.<\/p>\n<p>                                    THOMAS P.
