PUBLIC PROSECUTOR for\nRespondents. \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE M.D. SHAH\n\t\t\n\t\n\n \n\nDate\n: 04\/09\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>\t\tRULE.\n<\/p>\n<p> Mr. Pandya, learned APP waives the service of rule on behalf of<br \/>\nrespondents.\n<\/p>\n<p>1.\t\tBy<br \/>\nway of this application, the applicant has prayed to quash and set<br \/>\naside the judgment and order of the learned Additional Principal<br \/>\nJudge, Court No.2, City Sessions Court, Ahmedabad dated 31.07.2008<br \/>\npassed in Criminal Appeal No.41 of 2008.\n<\/p>\n<p>2.\t\tMr.\n<\/p>\n<p>Agrawal, learned Advocate for the applicant has submitted that the<br \/>\napplicant has already deposited the amount of cheque i.e. Rs.19,330\/-<br \/>\nand amount of compensation i.e Rs.5,670\/- before the trial Court on<br \/>\n10.01.2001 and 18.03.2008, respectively. Hence, the impugned judgment<br \/>\nand order passed by the appellate Court deserves to be quashed and<br \/>\nset aside. In support of his say, Mr. Agrawal has produced<br \/>\nphotocopies of the receipts dated 10.01.2001 and 18.03.2008 issued by<br \/>\nthe trial Court which are ordered to be taken on record.\n<\/p>\n<p>3.\t\tHeard<br \/>\nlearned Counsel for the parties and perused the documents placed on<br \/>\nrecord. The applicant, herein, had issued a cheque bearing No.475983<br \/>\ndrawn on Dena Bank dated 22.12.1998 for an amount of Rs.19,330\/-<br \/>\ntowards the goods purchased by her from the original<br \/>\ncomplainant-respondent No.2, herein.  However, the said cheque was<br \/>\ndishonoured by the Bank. Hence, respondent No.2 filed a complaint<br \/>\nbeing Criminal Case No.494 of 1999 against the applicant for the<br \/>\noffence punishable under Section 138 of the N.I. Act before the<br \/>\nlearned Metropolitan Magistrate, Court No.4, Ahmedabad (for short<br \/>\n&#8216;trial Court). During the pendency of proceedings before the trial<br \/>\nCourt, the applicant deposited the amount of cheque in the trial<br \/>\nCourt on 10.01.2001.  In view of the above, at the end of the trial,<br \/>\nthe trial Court took lenient view and sentenced the applicant to<br \/>\nundergo simple imprisonment of Till Rising Court and to pay<br \/>\nRs.25,000\/- and in case of default to undergo further simple<br \/>\nimprisonment for a period of three days for the aforesaid offence.\n<\/p>\n<p>4.\t\tThe<br \/>\napplicant, thereafter, preffered appeal against the judgment and<br \/>\norder of the trial Court being Criminal Appeal No.41 of 2008 before<br \/>\nthe Court of the learned Additional Principal Judge, City Sessions<br \/>\nCourt No.2, Ahmedabad(for short &#8216;appellate Court). The appellate<br \/>\nCourt after hearing all the parties, rejected the appeal of the<br \/>\napplicant and issued non-bailable warrant against her and also<br \/>\ndirected her to undergo the sentence imposed by the trial Court as<br \/>\nwell as to pay the amount in question within the stipulated time as<br \/>\ndirected by the trial Court.  However, while passing the impugned<br \/>\njudgment and order the appellate Court failed to appreciate the fact<br \/>\nthat the applicant had already deposited the amount of cheque i.e.<br \/>\nRs.19,330\/- as well as amount of compensation i.e. Rs.5,670\/- before<br \/>\nthe trial Court.  The appellate court also overlooked the fact that<br \/>\nthe appellant had already undergone simple imprisonment of one day of<br \/>\nTill Rising Court as imposed by the trial Court. I am, therefore, of<br \/>\nthe opinion that the judgment and order passed by the appellate Court<br \/>\nis required to be modified.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe result, the revision is partly allowed. The judgment and order of<br \/>\nthe learned Additional Principal Judge, Court No.2, City Sessions<br \/>\nCourt, Ahmedabad dated 31.07.2008 passed in Criminal Appeal No.41 of<br \/>\n2008 is partly modified. The order of the appellate Court issuing<br \/>\nnon-bailable warrant against the applicant to suffer the sentence of<br \/>\nimprisonment imposed by the trail Court as well as to pay the amount<br \/>\nof compensation is quashed and set aside.   Rest of judgment and<br \/>\norder of the appellate Court stands confirmed.
