Justice V.GIRI\n\n Dated :03\/07\/2009\n\n O R D E R\n                             V.GIRI,J.\n                      -------------------------\n                 W.P ( C) No.16362 of 2009\n                      --------------------------\n                Dated this the 3rd July,2009\n\n                        J U D G M E N T\n<\/pre>\n<p>      Third respondent was licensed           as a dealer for<\/p>\n<p>conducting    a  petrol    pump      at    Vedivachancoil  in<\/p>\n<p>Thiruvananthapuram in the SC\/ST quota. Petitioners are<\/p>\n<p>brothers of the 3rd respondent. It seems that they had<\/p>\n<p>advanced substantial amounts to 3rd respondent to enable<\/p>\n<p>him to start a petrol pump and also to obtain loan from<\/p>\n<p>the State Bank of Travancore. It further seems that the<\/p>\n<p>dealership of the 3rd respondent has been suspended by<\/p>\n<p>the Oil Company and it has now been entrusted to the 4th<\/p>\n<p>respondent.   Petitioners approached the Oil Company<\/p>\n<p>with a request that since they had advanced money to the<\/p>\n<p>3rd respondent and the amount has not been repaid, they<\/p>\n<p>should be permitted to run the petrol pump. This writ<\/p>\n<p>petition has been filed in relation to the said request made<\/p>\n<p>to the Oil company.\n<\/p>\n<p>W.P ( C) No.16362 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>      2.     A statement has been filed on behalf the 2nd<\/p>\n<p>respondent pointing out that the 3rd respondent has invoked<\/p>\n<p>the arbitration clause      against the 2nd respondent oil<\/p>\n<p>company, challenging the order of termination of his<\/p>\n<p>dealership and arbitration proceedings are pending. There<\/p>\n<p>is no privity of contract between the petitioners and the 2nd<\/p>\n<p>respondent and hence they are unable to countenance the<\/p>\n<p>request made by the petitioners.\n<\/p>\n<p>      3.     Heard learned counsel for the petitioners,<\/p>\n<p>learned standing counsel for the 2nd respondent and the<\/p>\n<p>learned standing counsel for the 4th respondent.<\/p>\n<p>      4.     As pointed out by the 2nd respondent, there is no<\/p>\n<p>privity of contract between the petitioners and 2nd<\/p>\n<p>respondent. If the petitioners have a grievance against<\/p>\n<p>their brother to whom they have allegedly advanced money<\/p>\n<p>and also stood surety for availing loan from a bank, it is up<\/p>\n<p>to them to take steps against the 3rd respondent.        This<\/p>\n<p>obviously can be done only before a Civil Court. Second<\/p>\n<p>respondent cannot be compelled to let the         petitioners<\/p>\n<p>participate in the running of the petrol pump merely<\/p>\n<p>W.P ( C) No.16362 of 2009<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>because the petitioners claim to have advanced money to<\/p>\n<p>the 3rd respondent.\n<\/p>\n<p>      In these circumstances, I find no merit in the writ<\/p>\n<p>petition.
