Respondent(s)\n\n\n\n\n                        ORDER\n<\/pre>\n<p>         Leave granted.\n<\/p>\n<p>         Despite notice of the special leave petition having been served on the<\/p>\n<p>   respondents, who have received notice personally, there is no appearance on their<\/p>\n<p>   behalf. Since such notices have been served in the month of February, 2008, fresh<\/p>\n<p>   notices were also directed to be served, which were issued in August, 2008. Even<\/p>\n<p>   then, there is no appearance on behalf of the respondents and in particular<\/p>\n<p>   respondent No. 1, who is the contesting respondent.<\/p>\n<p><span class=\"hidden_text\">                                                   -2-<\/span><\/p>\n<p>         The only question which arises for consideration in this appeal is whether<br \/>\nthe respondent was entitled to a<\/p>\n<p>personal hearing at the appellate stage when he had filed an appeal before the<\/p>\n<p>Appellate Authority against the order of the Disciplinary Authority, by which he had<\/p>\n<p>been awarded punishment of withdrawal of special pay as Special Assistant for 2<\/p>\n<p>years under Clause 6(g) of the Bipartite Settlement arrived at between the<\/p>\n<p>management and the workmen. Mr. Mehta, appearing in support of the appeal, has<\/p>\n<p>drawn our attention to the procedure for taking disciplinary action, as was indicated<\/p>\n<p>in the Bipartite Settlement and has laid special emphasis on paragraph 14 of the<\/p>\n<p>same which indicates that at the appellate stage, if an employee, who has been<\/p>\n<p>dismissed from service, asks for personal hearing, such prayer could be granted by<\/p>\n<p>the Appellate Authority. In other cases, no such provision has been made.<\/p>\n<p>        Mr. Mehta submitted that at the time of the disciplinary proceedings, the<\/p>\n<p>respondent was given all opportunities to defend himself and has also been given a<\/p>\n<p>hearing by the Disciplinary Authority. Mr. Mehta has also referred to and relied on<\/p>\n<p>the decision of this Court in State Bank of Patiala Vs. Mahendra Kumar Singhal,<\/p>\n<p>[1994<\/p>\n<p><span class=\"hidden_text\">                                    -3-<\/span><\/p>\n<p>(Suppl.) 2 SCC 463], where in a similar situation, it was observed   that the rules<\/p>\n<p>of natural justice did not<\/p>\n<p>necessarily in all cases confer a right to be heard personally at the appellate stage<\/p>\n<p>unless there was a rule to the contrary. In fact, such an observation was made<\/p>\n<p>following the Constitution Bench decision of this Court in F.N. Roy Vs. Collector of<br \/>\n     Customs, Calcutta, [1957 SCR 1151].\n<\/p>\n<p>             The facts of the case of this appeal being similar, we are unable to sustain the<\/p>\n<p>     order of the High Court impugned in this appeal remitting the matter to the<\/p>\n<p>     Appellate Authority for giving the respondent a personal hearing.<\/p>\n<p>             We, accordingly, set aside the impugned judgment of the High Court and<\/p>\n<p>     remit the matter to the High Court for fresh consideration with leave to the<\/p>\n<p>     respondent to raise the other questions taken in the writ petition, which do not<\/p>\n<p>     appear to have been gone into by the High Court, since the submissions before the<\/p>\n<p>     High Court were confined only to the question as to whether the respondent was<\/p>\n<p>     entitled to a personal hearing before the Appellate Authority.<\/p>\n<p><span class=\"hidden_text\">                                                   -4-<\/span><\/p>\n<p>             The Civil Appeal is allowed in the above terms.\n<\/p>\n<p>             There will be no order as to costs.\n<\/p>\n<\/p>\n<p>                                                           &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p>\n<p>                               (ALTAMAS KABIR)<\/p>\n<p>                                              &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.\n<\/p>\n<p>                                      (CYRIAC JOSEPH)<\/p>\n<p>New Delhi,<br \/>\nJanuary 05, 2009.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Punjab National Bank &amp; Anr vs O.N.Sharma &amp; Ors on 5 January, 2009 Author: &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.J.
