HEMA, J.\n                    ---------------------------\n                    B.A. No. 2793 of 2010\n                ------------------------------------\n             Dated this the 15th day of July, 2010\n\n                             O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.<\/p>\n<p>     2.   The alleged offences are under Sections 143, 147,<\/p>\n<p>148, 341, 323 and 308 read with Section 149 of the Indian<\/p>\n<p>Penal Code.    According to prosecution,       petitioners(accused<\/p>\n<p>nos.1 to 6) formed themselves into an unlawful assembly<\/p>\n<p>restrained de facto complainant and assaulted him using knife<\/p>\n<p>and thereby committed the above offences. The incident<\/p>\n<p>happened on 11.3.2010 at about 7 P.M.\n<\/p>\n<p>     3. Learned counsel for petitioners submitted that offence<\/p>\n<p>under Section 308 of the Indian Penal Code is included only<\/p>\n<p>with a view to harass petitioner. As per the allegations in the<\/p>\n<p>F.I. Statement, petitioners aimed a stab at the neck of de<\/p>\n<p>facto complainant but hit fell on the back side of the de facto<\/p>\n<p>complainant. Offence under Section 308 of the Indian Penal<\/p>\n<p>Code is not involved, it is submitted.\n<\/p>\n<p>     4.   This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that is the second application for anticipatory bail.<\/p>\n<p><span class=\"hidden_text\">B.A. No. 2793 \/ 2010               2<\/span><\/p>\n<p>The earlier application was dismissed as per Annexure-2 order.<\/p>\n<p>The weapon is not so far recovered. On the facts of the case this<\/p>\n<p>is not a fit case to grant anticipatory bail. A knife was used for<\/p>\n<p>commission of the offence and injury of considerable nature are<\/p>\n<p>sustained by de facto complainant on the forehead as well as<\/p>\n<p>near the spine which is 6 cm deep. The injury on the forehead<\/p>\n<p>was sutured also.\n<\/p>\n<p>        5. On hearing both sides, I find that this is the second<\/p>\n<p>application for anticipatory bail. As per annexure A2 order, the<\/p>\n<p>earlier application for anticipatory bail was dismissed as early as<\/p>\n<p>on 16.04.2010. It was observed in the said order by another<\/p>\n<p>bench of this court as follows:\n<\/p>\n<p>                   &#8220;Having  regard    to    the  facts   and<\/p>\n<p>            circumstances involved in the case, especially<\/p>\n<p>            the gravity of the offences involved and the<\/p>\n<p>            allegations, I am not inclined to grant<\/p>\n<p>            anticipatory bail to the petitioners as the same<\/p>\n<p>            will adversely affect the investigation in the<\/p>\n<p>            above crime which is now in progress. It is<\/p>\n<p><span class=\"hidden_text\">B.A. No. 2793 \/ 2010               3<\/span><\/p>\n<p>            also relevant to note the grievous nature of<\/p>\n<p>            the injures sustained by the victim and the<\/p>\n<p>            weapons used to inflict such injuries     which<\/p>\n<p>            are also relevant facts which persuade this<\/p>\n<p>            Court to decline anticipatory bail in favour of<\/p>\n<p>            the petitioners.\n<\/p>\n<p>                   In the result, I find no reason to grant<\/p>\n<p>            anticipatory   bail   to   the  petitioners by<\/p>\n<p>            exercising the extra ordinary jurisdiction of<\/p>\n<p>            this Court under Section 438 of the Code of<\/p>\n<p>            Criminal Procedure. There fore, there is no<\/p>\n<p>            merit in this petition and accordingly, the<\/p>\n<p>            same is dismissed.&#8221;\n<\/p>\n<p>      6. I do not find any reason to come to a different view. The<\/p>\n<p>incident    happened     more    than   4  months   back  and  the<\/p>\n<p>investigation is in stand still, since the petitioners have not co-<\/p>\n<p>operated with the investigation. Considering the serious nature<\/p>\n<p>of the allegations made also, I am of opinion that anticipatory<\/p>\n<p>bail cannot be granted in a case of this nature. Petitioners are<\/p>\n<p><span class=\"hidden_text\">B.A. No. 2793 \/ 2010                4<\/span><\/p>\n<p>bound to surrender and co-operate with the investigation. Hence,<\/p>\n<p>the following order is passed:\n<\/p>\n<blockquote><p>             1. Petitioners shall surrender before the<\/p>\n<p>                  investigating officer forthwith and co-<\/p>\n<p>                  operate with the investigation without any<\/p>\n<p>                  delay.\n<\/p><\/blockquote>\n<blockquote><p>             2.    No further application for anticipatory bail<\/p>\n<p>                  by petitioners    in  this  crime   will be<\/p>\n<p>                  entertained in this court hereafter.<\/p>\n<p>      This petition is dismissed.<\/p><\/blockquote>\n<p>                                               K.
