No.9429 of 2011\n                  GANESH MAHTO SON OF BHUNESHWAR MAHTO.\n                                          Versus\n                               THE STATE OF BIHAR\n                                        -----------\n<\/pre>\n<p>2   18.04.2011                Heard learned counsels for the petitioner and<\/p>\n<p>                 the State.\n<\/p>\n<p>                              The   petitioner   being   the   husband    is<\/p>\n<p>                 apprehending his arrest in a complaint case in which<\/p>\n<p>                 cognizance has been taken under Section 498A of the<\/p>\n<p>                 Indian Penal Code.\n<\/p>\n<p>                              Though, there is accusation of demand of<\/p>\n<p>                 dowry and torture, but, it is submitted by learned<\/p>\n<p>                 counsel for the petitioner that the complainant has<\/p>\n<p>                 performed second marriage and there is an issue from<\/p>\n<p>                 second husband also.\n<\/p>\n<p>                              Considering the aforesaid facts, let the above<\/p>\n<p>                 named petitioner, be released on anticipatory bail, in<\/p>\n<p>                 the event of his arrest or surrender before the learned<\/p>\n<p>                 Court below within a period of 12 weeks from today,<\/p>\n<p>                 on furnishing bail bond of Rs. 10,000\/- (ten thousand)<\/p>\n<p>                 with two sureties of the like amount each to the<\/p>\n<p>                 satisfaction of the learned Judicial Magistrate 1st Class,<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>             Jamui in connection with Complaint Case No.<\/p>\n<p>             224C\/2004, subject to the conditions as laid down<\/p>\n<p>             under Section 438(2) Cr.P.C.\n<\/p>\n<p>                        The complainant will be at liberty to file an<\/p>\n<p>             application for cancellation of the bail of the petitioner,<\/p>\n<p>             if the aforesaid contentions of the petitioner are found<\/p>\n<p>             to be false.\n<\/p>\n<\/p>\n<p>                                           (Dinesh Kumar Singh, J.)<br \/>\nAmrendra\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Ganesh Mahto vs The State Of Bihar on 18 April, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
