No.273 of 2011\n            - - - - - - - - - - - - - - - - - - - - - - - - - -\n         Dated this the 31st day of January, 2011.\n\n\n                             O R D E R\n<\/pre>\n<p>    The accused in a prosecution for the offence under<\/p>\n<p>section 138 of the Negotiable Instruments Act,1881 (for<\/p>\n<p>short `the N.I Act&#8217;) approached this Court by preferring<\/p>\n<p>the above revision petition challenging his conviction<\/p>\n<p>and sentence, imposed as per judgments of the trial<\/p>\n<p>court as well as the lower appellate court.<\/p>\n<p>    2. I have heard learned counsel for the revision<\/p>\n<p>petitioner as well as counsel for the respondents.<\/p>\n<p>    3. As this court is not inclined to interfere with the<\/p>\n<p>order of conviction recorded by the courts below, the<\/p>\n<p>learned counsel for the revision petitioner submitted<\/p>\n<p>that the sentence of imprisonment ordered by the court<\/p>\n<p>below is exorbitant and unreasonable and further<\/p>\n<p>submitted that some breathing time may be granted to<\/p>\n<p>the revision petitioner to pay the compensation amount<\/p>\n<p>and permit him to pay the same to the complainant<\/p>\n<p>directly. Having regard to the facts and circumstances<\/p>\n<p>involved in the case, I am of the view that, the said<\/p>\n<p>submission requires serious consideration.    But at the<\/p>\n<p>same time, the interest of the complainant has also to<\/p>\n<p>be protected, especially in the light of the decision<\/p>\n<p>reported in <a href=\"\/doc\/1594211\/\">Damodar S.Prabhu v. Sayed Babalal<\/a> .H.<\/p>\n<p>(JT 2010 (4) SC 457), wherein it is held that, in case of<\/p>\n<p>dishonour of cheques, the compensatory aspect of the<\/p>\n<p>remedy should be given priority over the punitive<\/p>\n<p>aspects. The cheque in question is dated 15.10.2003 for<\/p>\n<p>an amount of Rs.1,00,000\/-.\n<\/p>\n<p>    4. Considering the above settled legal position and<\/p>\n<p>the facts which I referred to above, I am of the view<\/p>\n<p>that the sentence of imprisonment ordered against the<\/p>\n<p>revision petitioner requires modification and while<\/p>\n<p>granting time to the revision petitioner to pay the<\/p>\n<p>compensation. The compensation amount can be<\/p>\n<p>enhanced slightly, considering the fact that, the amount<\/p>\n<p>covered by the cheque in question is due to the<\/p>\n<p>complainant for the last 7 years.\n<\/p>\n<p>     In the result, this revision petition is disposed of<\/p>\n<p>confirming the conviction of the revision petitioner<\/p>\n<p>under Section 138 of N.I Act as recorded by the court<\/p>\n<p>below and accordingly, the sentence of imprisonment<\/p>\n<p>ordered by the court below is modified and reduced to<\/p>\n<p>one day simple imprisonment that till the rising of the<\/p>\n<p>court. Whereas, the revision petitioner is further<\/p>\n<p>directed to pay a compensation of Rs.1,30,000\/- (Rupees<\/p>\n<p>One lakh thirty thousand only) to the complainant<\/p>\n<p>within three months from today and in default, the<\/p>\n<p>revision petitioner is directed to undergo simple<\/p>\n<p>imprisonment for a period of 3 months. Accordingly,<\/p>\n<p>the revision petitioner is directed to appear before the<\/p>\n<p>trial court on 04.04.011. It is made clear that, the<\/p>\n<p>revision petitioner is free to pay the enhanced<\/p>\n<p>compensation either directly to the complainant or by<\/p>\n<p>way of remitting the same in the trial court, which ever<\/p>\n<p>subject to the satisfaction of the learned Magistrate. If<\/p>\n<p>there is any failure on the part of the revision petitioner<\/p>\n<p>in appearing before the court below and paying the<\/p>\n<p>compensation amount, the trial court is free to take<\/p>\n<p>coercive steps to secure the presence of the revision<\/p>\n<p>petitioner and to execute the sentence and for<\/p>\n<p>realisation of the fine amount.
