JUSTICE GOPAL KRISHAN VYAS\n\nMr.N.R. Choudhary, for the appellants.\nMr.Himansu Shrimali, for the respondents.\n\n\n\n            Heard learned counsel for the parties and\nperused the impugned order.\n            The application filed by the appellants\nfor bringing them on record as appellants due to\ndeath of original appellant was dismissed by the\nlearned trial court on the ground that application\nwas     filed     after     delay    of         248     days        and    no\nreasonable explanation have been furnished by the\nappellants        before    the     trial           court    for        filing\napplication after delay of 248 days.\n            Learned        counsel            for     the        appellants\nsubmits     that    as     per    adjudication              made    by     the\nHon'ble    Supreme        Court   and         Rajasthan          High    Court\nreported     in     AIR    2004     SC        4346     <a href=\"\/doc\/1505230\/\">(K.Rudrappa         v.\nShivappa) and RLW<\/a> 2005 (1) Raj. 270 (Mohan Devi @\nMohini Devi (Smt.) vs. LRS of Himmat Lal Menaria)\nrespectively, the delay was to be condoned by the\ntrial     court      for      the        purpose            of     allowing\napplication filed by the appellants for impleading\n                                          !! 2    !!\n           them as appellants.\n                      For the reasons mentioned in this appeal,\n           I am of the opinion that the order or learned\n           trial court is not justified.               The delay was to be\n           condoned      upon    the     reasons       furnished     by    the\n           appellants before the appellate court, but it has\n           not been done, which is not proper.\n\n                      In this view of the matter, the impugned\n           order dated 12th August, 2008 is hereby set aside\n           and the application filed by the appellants before\n           the Additional District &amp; Sessions Judge, Barmer\n           for impleading them as appellants is allowed and\n           matter   is    remitted       to    the    appellate    court   for\n           deciding      the    appeal    on    merits.      However,      the\n           appellants No.1\/2 to 1\/4 are directed to pay the\n           cost of Rs.1500\/- to the respondents.\n\n                      With      the   above     observations\/directions,\n           this misc. appeal is disposed of.\n\n\n                                                 (GOPAL KRISHAN VYAS),J.\n<\/pre>\n<p>A.K.
