Justice R.BASANT\n\n Dated :07\/03\/2007\n\n O R D E R\n                                 R.BASANT, J\n\n                              ----------------------\n\n                          Crl.M.C.No.616 of 2007\n\n                        ----------------------------------------\n\n                 Dated this the 7th day of March  2007\n\n\n\n\n                                   O R D E R\n<\/pre>\n<p>      The petitioner is the owner of a vehicle.  According to him,<\/p>\n<p>he  had   purchased  the  vehicle  bona  fide   for  consideration.     The<\/p>\n<p>police   have   now   seized   the   vehicle.     Police   suspects   that   the<\/p>\n<p>vehicle is a stolen vehicle and there has been tampering with the<\/p>\n<p>engine   number   and   chasis   number   of   the   vehicle.     The   vehicle<\/p>\n<p>was   seized   in   the   course   of   investigation.     The   police   have   no<\/p>\n<p>case so far that the petitioner has any contumacious role in the<\/p>\n<p>commission   of   the   offence.                 The   petitioner,   in   these<\/p>\n<p>circumstances, applied for release of the vehicle to him.  There is<\/p>\n<p>no   other   claimant   for   the   vehicle.     The   learned   Magistrate<\/p>\n<p>accepted   the   request   for   release   of   the   vehicle,   subject   to<\/p>\n<p>conditions.     The   petitioner   complains   about   one   condition<\/p>\n<p>imposed, that is condition No.3, which I extract below:\n<\/p>\n<blockquote><p>             &#8220;The   petitioner   shall   produce   the   bank<\/p>\n<p>      guarantee for the bond amount or to produce the title<\/p>\n<p>      deeds   of   the   immovable   property   in   originals   of   the<\/p>\n<p>      sureties as security&#8221;.<\/p><\/blockquote>\n<p><span class=\"hidden_text\">Crl.M.C.No.616\/07                        2<\/span><\/p>\n<p>      2.     The learned counsel for the petitioner submits that the<\/p>\n<p>learned Magistrate had already imposed condition No.1 that the<\/p>\n<p>petitioner must execute a bond for Rs.7,00,000\/- with two solvent<\/p>\n<p>sureties   each   for   the   like   sum.     In   these   circumstances,   it   is<\/p>\n<p>unnecessary to insist on condition No.3.  Because of the onerous<\/p>\n<p>nature of condition No.3, the petitioner is   unable to claim back<\/p>\n<p>the   vehicle.     It   is,   in   these   circumstances   prayed   that   the   said<\/p>\n<p>condition  may be  deleted.    The   petitioner  shall  produce   solvent<\/p>\n<p>sureties.     The   requisite   satisfaction   in   the   mind   of   the   learned<\/p>\n<p>Magistrate   that   the   sureties   are   solvent   shall   be   induced   by<\/p>\n<p>production   of   appropriate   documents.     A   rigid   insistence   on<\/p>\n<p>production   of   bank   guarantee   or   title   deeds   may   not   be   made.\n<\/p>\n<p>This, in short, is the request made by the counsel.\n<\/p>\n<p>      3.     I must take note of the decision in <a href=\"\/doc\/25703131\/\">Sunderbhai Ambalal<\/p>\n<p>Desai v. State of Gujarat<\/a> [SC 2003(2) KLT 1089].  The vehicle has<\/p>\n<p>not been taken release from the custody of the court.  There is no<\/p>\n<p>other claimant also.   In these circumstances, it is very essential<\/p>\n<p>that   the   property   is   preserved   and   protected.     I   am,   in   these<\/p>\n<p>circumstances, satisfied that insistence on bank guarantee need<\/p>\n<p>not be made.   The rigid  insistence on production of originals of<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.616\/07                     3<\/span><\/p>\n<p>the title deeds of the sureties can also be dispensed with.  It need<\/p>\n<p>only   be   directed   that   the   learned   Magistrate   must   carefully<\/p>\n<p>evaluate the sufficiency and  acceptability  of the sureties.\n<\/p>\n<p>       4.    In   the   result,   this  Criminal   Miscellaneous   Case    is<\/p>\n<p>allowed in part.  Condition No.3 is deleted.
