SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/07\/2008 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>Present<br \/>\n\tAppeal From Order  is   filed by the appellants ?  original<br \/>\n\tdefendant Nos.5 and 6  of Special Civil Suit No. 87 of 2006  to<br \/>\n\tquash and set aside the judgement and order dtd.12\/5\/2006 passed by<br \/>\n\tthe learned Additional Senior Civil Judge, Viramgam below<br \/>\n\tapplication Ex.5 in Special Civil Suit No.  87 of 2004 to the extent<br \/>\n\tthe said order operates against the following properties;\n<\/p>\n<p>Survey<br \/>\n\tNos.92 Paiki, 749, 786, 787 of Village Zezra, Taluka Viramgam,<br \/>\n\tDistrict ; Ahmedabad and Survey Nos.477-A  Paiki of Mouje Viramgam,<br \/>\n\tTaluka Ahmedabad being properties belonging to the appellant No.1.\n<\/p>\n<p>Survey<br \/>\n\tNos.92 Paiki, 130, 1273 of Village Zezra, Taluka Viramgam, District<br \/>\n\t; Ahmedabad being properties belonging to the appellant No.2.\n<\/p>\n<p>Survey<br \/>\n\tNo.700 of Village Zezra, Taluka Viramgam, District ; Ahmedabad and<br \/>\n\tSurvey Nos.400 and 439 of village Bhojwa being properties jointly<br \/>\n\towned by the appellants.\n<\/p>\n<p>Survey<br \/>\n\tNos.69 Paiki and 1071 of Village Zezra, Taluka Viramgam, District ;<br \/>\n\tAhmedabad being properties belonging to Parimal Ishwarlal Thakkar.\n<\/p>\n<p>Survey<br \/>\n\tNos.69  Paiki and 1003 of Village Zezra, Taluka Viramgam, District ;<br \/>\n\tAhmedabad being properties belonging to Milan Ishwarlal Thakkar.\n<\/p>\n<p>Survey<br \/>\n\tNo. 227 of Village Zezra, Taluka Viramgam, District ; Ahmedabad and<br \/>\n\tSurvey No.44 of Mouje Viramgam being properties jointly owned by the<br \/>\n\tappellant No.2 and respondent No.3.\n<\/p>\n<p>The<br \/>\n\trespondent No.1 has filed Special Civil Suit No.  87 of 2004 against<br \/>\n\tthe appellants for recovery of Rs.57,71,755=00 for the goods \/<br \/>\n\tcotton sold to the defendant Nos.1 to 3. In the said suit, the<br \/>\n\tplaintiff filed an application for interim injunction at Ex.5<br \/>\n\tagainst all the defendants and the learned Additional Senior Civil<br \/>\n\tJudge, Surendranagar, vide order dtd.12\/5\/2006 allowed the<br \/>\n\tapplication Ex.5 directing all the defendants to maintain status quo<br \/>\n\twith respect to all the properties mentioned in the suit. Being<br \/>\n\taggrieved by and dissatisfied with the order passed below<br \/>\n\tapplication Ex.5 in so far as original defendant Nos.5 and 6 by<br \/>\n\twhich the appellants herein ?  original defendant Nos.5 and 6  are<br \/>\n\tdirected to maintain status quo, the present Appeal From Order is<br \/>\n\tfiled.\n<\/p>\n<p>It<br \/>\n\tis the contention on behalf of the appellants that as such in the<br \/>\n\tsuit no relief is prayed against the defendant Nos.5 and 6. It is<br \/>\n\talso the contention on behalf of the appellants that the  even the<br \/>\n\tappellants are not party to the transaction. Therefore, it is<br \/>\n\trequested to allow the present Appeal From Order.\n<\/p>\n<p>Mr.Tushar<br \/>\n\tMehta, learned advocate appearing on behalf of the  plaintiff  has<br \/>\n\tto concede that there is no averments or prayer against defendant<br \/>\n\tNos.5 and 6 in the aforesaid suit.\n<\/p>\n<p>It<br \/>\n\tis to be noted that Civil Application No. 11553 of 2006 in the<br \/>\n\tpresent Appeal From Order,  came to be  heard by the  learned Single<br \/>\n\tJudge (Coram : P.B. Majmudar, J. as the then he was) and considering<br \/>\n\tthe fact that there are no averments  or no prayer made against the<br \/>\n\tappellants and that the appellants are not party to the transaction,<br \/>\n\thas stayed the injunction granted against the defendant Nos.5 and 6<br \/>\n\tby the trial court  and the said interim relief has been continued<br \/>\n\ttill date. It appears to this Court also that the learned trial<br \/>\n\tcourt has committed an error in granting injunction against the<br \/>\n\tappellants ?  original defendant Nos.5 and 6 inasmuch as there is<br \/>\n\tno prayer against the appellants ?  original defendant Nos.5 and 6<br \/>\n\tin the suit and there are no averments also against the appellants<br \/>\n\tin the suit. Even the appellants are  not party to the transaction.<br \/>\n\tUnder the circumstances, there was no question of granting<br \/>\n\tinjunction against the appellants.  In the facts and circumstances<br \/>\n\tof the case, the trial court has committed error in granting<br \/>\n\tinjunction against the appellants which requires to be quashed and<br \/>\n\tset aside.\n<\/p>\n<p>For<br \/>\n\tthe reasons stated above, the appeal succeeds.  The impugned  the<br \/>\n\tjudgement and order dtd.12\/5\/2006 passed by the learned Additional<br \/>\n\tSenior Civil Judge, Viramgarm below application Ex.5 in Special<br \/>\n\tCivil Suit No. 87 of 2004 in so far as against the appellants ?<br \/>\n\toriginal defendant Nos.5 and 6, is hereby quashed and set aside.<br \/>\n\tRule is made absolute accordingly. In view of disposal of the Appeal<br \/>\n\tFrom Order, no order in Civil Application.
